1. Inkqubo yokuqeshwa kukatitshala osesikolweni njengomqeshwa obambeleyokwisikhundla esiphezulu esingenamntu esihlawulelwayo nengcaciso ngokuhlawulwa kwesibonelelo sokubambela kwiimeko ezilolu hlobo, yayaziswe kwiiSetyhula 0031/2003 no-0045/2002. Le ngcaciso imfutshane yeyokongezelela kwimiqathango yezi setyhula zangaphambili.

2. Makungqinelwane ngqo nale nkqubo ilandelayo, ngokwemigqaliselo yeZigqibo zoThetha-thethwano neMibutho yaBasebenzi (Collective Agreements)8/2001, 8/2002 no-1/2008, ze-Education Labour Relations Council (ELRC) ngokumalunga neentlawulo zokubambela xa kutyunjwa abaqeshwa benkonzo karhulumente amabaqeshwe njengababambeleyo kwisithuba esiphezulu esingenamntu esihlawulelwayo.
2.1 Imigaqo ngokubanzi

  1. Kuphela ngumqeshwa oqeshwe isigxina liSebe leMfundo leNtshona Koloni (ISebe iWCED) onokuqeshwa njengobambeleyo kwisithuba esiphezulu esingenamntu esihlawulelwayo okanye kwisithuba apho umqeshwa okuso angekhoyo (ngokuxhomekeke kwimihlathi 2.2 no-2.3 apha ngezantsi. Nakuphi na ukuqeshwa ngemvumelwano (contract appointment) makwenziwe kwisithuba esikwinqanaba eliphezulu.
  2. Utitshala ozifezekisayo iimfuno ezizezona zisezantsi kumhlathi 2(2) weSahluko B se-Personnel Administration Measures, uya kuqeshwa njengobambeleyo ngencwadi ebhaliweyo yintloko yeziko/yinqununu kwisithuba esiphezulu, esingenamntu nesihlawulelwayo. Utitshala ke ngoko makazifezekise iimfuno ezizezona zisezantsi zesithuba esiphezulu ukwenzela ukuba akufanele ukubambela kweso sithuba yaye makakwamkele okanye akukhabe ukuqeshwa kwakhe ngencwadi ebhaliweyo.
  3. Utitshala uya kuqalisa yonke imisebenzi eluxanduva lwakhe malunga neso sithuba kangangethuba aqeshelwe lona.
  4. Utitshala angaqeshwa ukuba abambele kuphela kwisithuba esiphezulu esingenamntu, esihlawulelwayo esiphezulu ngenqanaba elinye kuneso sikhundla akuso ngelo xesha. Nakuphi na ukutenxa kule migaqo makuxhaswe ngokupheleleyo zizizathu ezivokothekileyo yaye makuninkwe neengcebiso ngumphathi wesekethe nangumlawuli wesithili
  5. Isibonelelo sokubambela ngumahluko phakathi kwenotshi yomvuzo womqeshwa awufumana ngelo xesha (ngaphandle kwamaqithi-qithi) nenotshi yomvuzo womntu oqalayo kwisithuba esiphezulu esingenamntu esihlawulelwayo (ngaphandle kwamaqithi-qithi).
  6. Ukuba umqeshwa ukwinotshi yomvuzo (kuqukwa inotshi eyenzelwa yena buqu (personal notch)) engaphezulu kwenotshi yomvuzo womntu oqalayo kwisithuba esiphezulu esingenamntu esihlawulelwayo aqeshwe kuso, isibonelelo sokubambela siya kuba ziinotshi eziyi-6.
  7. Isibonelelo sokubambela asixhuzulwa mali yomhlalaphantsi.
  8. Apho isithuba sokubambela sikwiziko okanye sikwi-ofisi ekwenye indawo engeyiyo leyo yomsebenzi akuyo umqeshwa, intlawulo yesibonelelo senkxaso sokutya nohambo (subsistence and travel allowance) esifanelekileyo naso siya kuthathelwa ingqalelo.
2.2 Izithuba zengqesho eziphezulu ezingenamntu nezihlawulelwayo
Isibonelelo sokubambela siya kuhlawulwa kuphela kutitshala ngokwale miqathango ilandelayo:

  1. Isithuba sokubambela ekuqeshwa kuso sisithuba esiphezulu esingenamntu nesihlawulelwayo.

  4. Makwenziwe isicelo esitsha sethuba elingaphezu kweenyanga eziyi-12. Isicelo esilolu hlobo asiyi kuthathwa njengokwandiswa kwexesha yaye siya kuthathwa njengesicelo/njengemvumelwano/njengethuba lokubambela elitsha.
  5. Intlawulo eyimbuyekezo iya kuqaliswa kumhla wangaphambili awaqala ngawo ukubambela utitshala, ngokuxhomekeke ekubeni intlawulo yokuqala yenziwa kwinyanga elandela ukugqitywa kweeveki eziyi-6 zokubambela ezikhankanyiweyo kumhlathi b) apha ngentla.
2.3 Ukubambela kwisithuba esiphezulu esingenamntu esihlawulelwayo apho kungekho mqeshwa usisigxina kuso

  1. Ukuba ithuba lokubambela lide kuneeveki eziyi-12 kodwa liqingqwe laziinyanga eziyi-12 ezona zininzi, isibonelelo sokubambela siya kuhlawulwa kuphela kutitshala obambele kwisithuba apho umqeshwa osisigxina okuso angekhoyo ngenxa yezi zizathu zilandelayo:
    1. Ekwikhefu lokuya kubeleka (maternity leave)
    2. Ekwikhefu lokugula (sick leave)
    3. Enqunyanyisiwe emsebenzini (suspension)
    4. Xa esekondiwe; okanye
    5. Ekwikhefu elilodwa (special leave) elivunyiweyo.
  2. Intlawulo eyimbuyekezo iya kuqaliswa kumhla wangaphambili utitshala awaqala ngawo ukubambela, ngokuxhomekeke ekubeni intlawulo yokuqala yenziwa kwinyanga elandela ukugqitywa kweeveki eziyi-12 ezikhankanyiweyo kumhlathi a) apha ngentla.
3. Inkqubo yokutyumba abagqatswa:

  1. Intloko yeziko/inqununu mayityumbe igama lomqeshwa.
  2. Intloko yeziko/inqununu mayingqinisise ukuba kuyangqinelana na nemigqaliselo ukutyunjwa komgqatswa yaye mayiqinisekise ukuba aqhotyoshelwe onke amaxwebhu phambi kokunika iingcebiso ngaso nokusithumela isicelo kumphathi wesekethe.
  3. Ibhunga lolawulo liya kucelwa ukuba linike iingcebiso kwiSebe iWCED ngokuba utitshala, otyunjwe yintloko yeziko/yinqununu, uqeshelwa ukuba abambele kwisithuba esiphezulu esingenamntu esihlawulelwayo.
  4. Apho kukho ngaphezu komgqatswa omnye, inqununu mayazise ngesithuba kwalapha ngaphakathi yaye mayisebenzise inkqubo yokhetho engakhethi cala.
  5. Umgaqo-nkqubo weSebe iWCED ukwalungiselela ukuba abasebenzi abangaphezu kwemfuneko okanye abaqeshwa abanamabanga emfundo afanelekileyo kwicandelo elo, banikwe ithuba lokubambela ngokubolekisanayo (on a rotational basis).
4. Le fom yesicelo iqhotyoshelwe apha yesibonelelo sokubambela mayingeniswe kuMlawuli weCandelo lokuGaya nokuKhetha aBasebenzi ukwenzela ukuba kulungiswe intlawulo. Izizathu ezibhaliweyo ezivokothekileyo nezikucacisa ngokupheleleyo oku, mazihanjiswe kunye naziphi na iimeko ezitenxileyo kule migqaliselo imiselweyo.

5. Igunya lokuvunywa kokuqeshwa kwababambeleyo kootitshala abasezikolweni liphathiswe igosa elikwinqanaba 6 lesithuba (post level 6) (umphathi wesekethe) we-ofisi yesithili apho limi khona iziko/isikolo. Makwenziwe zonke iinzame zokufumana imvume phambi kokuqalisa komqeshwa kwisithuba sokubambela.

6. Isithuba sokubambela simele ukupapashwa yaye sizaliswe zingadlulanga iinyanga eziyi-12 singenamntu ngaphandle kwaxa umqeshwa osisigxina okuso ekwikhefu lokuya kubeleka, ekwikhefu lokugula, enqunyanyiswe emsebenzini, esekondiwe okanye ekwikhefu elilodwa elivunyiweyo. Izicelo ezilolu hlobo zimele ukuhanjiswa nenkcazo enika izizathu ezivokothekileyo.

7. Abaqeshwa mabaqaphele ukuba ukuqeshwa kwabo njengababambeleyo akubaniki lungelo okanye balindela ukuba baqeshwe isigxina ngokukhawuleza sakuba isithuba eso sipapashiwe.

8. Kucelwa wazise okukule ngcaciso imfutshane bonke abaqeshwa abachaphazelekayo ukuze bakuthathele ingqalelo.
