1. The procedure for the appointment of an office-based educator or a public servant to a higher vacant and funded post in an acting capacity and information on the payment of an acting allowance in such cases was communicated in Circulars 0010/2010, 0142/2003 and 0103/2002. This minute supplements the provisions of the previous circulars.

2. The following procedures, as per the stipulations of Chapter 1, Part VII, paragraph B5 of the Public Service Regulations of 2016, as amended, Public Service Coordinating Bargaining Council (PSCBC) Resolution 9 of 2001 and PSCBC Resolution 1 of 2002, on the payment of acting allowances must be adhered to when nominating officebased educators or public servants for appointment to a higher vacant and funded post in an acting capacity:

  1. Only an employee permanently employed by the Western Cape Education Department (WCED) may be appointed to a higher vacant and funded post in an acting capacity. Any contract appointment must thus be made on the higher post level.
  2. The period of appointment must be uninterrupted and longer than six weeks, but must not exceed 12 months.
  3. A new application must be made for a period that exceeds 12 months. Such application will not be regarded as an extension and will be treated as a new application/contract/acting period.
  4. The head of the component must inform the employee in writing of his or her appointment to the higher vacant and funded post in an acting capacity and the employee must accept or decline the appointment in writing.
  5. An acting allowance shall be paid, provided the post is vacant and funded. (No acting allowance shall be paid to personnel acting in a post because the permanent incumbent is on leave.)
  6. An acting allowance is the difference between the employee’s current salary notch and the starting salary notch of the higher vacant and funded post.
  7. If an employee is on a salary notch (including a personal notch) higher than the starting salary notch of the higher vacant and funded post to which he or she is appointed, the acting allowance will be the difference between the current salary notch and the next higher salary notch applicable to the higher vacant and funded post, provided that there is a difference. If the higher vacant and funded post is a Senior Management Service (SMS) post, the difference between the current salary notch and 70% of the inclusive flexible remuneration package is payable, provided that there is a difference. In the case of office-based educators, 6 notches will apply.
  8. An acting allowance is non-pensionable.
  9. An acting allowance will be paid monthly, provided that the first payment takes place in the month following the completion of the six weeks referred to in paragraph 2(b) above.
3. The nomination process:

  1. The head of the component must make the nomination.
  2. The director must verify that the nomination adheres to prescripts and ensure that all documentation is received before recommending and sending the application to the Director: Recruitment and Selection.
  3. Where there is more than one candidate, the director must go through an objective selection process.
  4. The policy of the WCED also makes provision for excess staff or other suitably qualified employees in the section to be afforded the opportunity to act on a rotational basis.
4. The attached application form for an acting allowance must be submitted to the Director: Recruitment and Selection for the processing of payment. A full written motivation must accompany any deviation from the prescripts.

5. All acting appointments are subject to the approval of the Chief Director: People Management Practices. Every effort must be made to obtain approval before the commencement of an acting appointment.

6. Employees must note that their acting appointment does not give them a right to or expectation of permanent appointment to the post as soon as it is advertised.

7. Kindly bring the contents of this minute to the attention of all employees.
