1. Inkqubo yokuqeshwa kotitshala obambela omnye kwisithuba esongezelelweyo xa ebengekho utitshala ngenxa yokugula, ukuya kubeleka okanye ngenxa yekhefu elilodwa (maternity or special leave) yachazwa kwiiSetyhula 0006/1997, 0024/1997, 0052/1997, 0082/1997 kunye no-0003/2011. 2. ISahluko 3, umhlathi 7(2)(b) woMthetho weNgqesho wooTitshala, ka-1988 (uMthetho 76 ka-1998), njengoko ufakelwe izilungiso, umisela ukuba igunya elilawulayo linako, oko kusenziwa kungagqithiswanga kwibhajethi ekhoyo, ukuqesha ootitshala ngokungesosigxina (temporary capacity) kangangethuba eliqingqiweyo, nokuba ngaba eso sisithuba sesigxina (full-time), nokuba sisithuba esingesosigxina (part-time) okanye luxanduva lokwabelana ngomsebenzi.

3. Kule minyaka isandula kudlula, ibisoloko ingumgaqo-nkqubo weSebe leMfundo leNtshona Koloni (iWCED) ukuqesha ootitshala ababambele abanye kwikhontraki yethuba eliqingqiweyo (fixed-term contract) ngethuba lokungabikho emsebenzini (iintsuku eziyi-10 okanye ngaphezulu) kukatitshala osisigxina.

Nangona oku ikukuhlawulwa umvuzo kabini (double payment) ngomsebenzi omnye, kuqeshwa utitshala ilalela ukwenzela ukuba abafundi bangachatshazelwa kakubi kukungabikho kukatitshala osisigxina.


4. Ngenxa yemingeni yebhajethi ekhoyo yeWCED, iNtloko yeSebe leMfundo inike imvume yokuba kusebenze le mimiselo ilandelayo:

  1. Izicelo zootitshala abongezelelweyo abaya kuqeshwa njengababambeleyo xa bengekho ootitshala ziya kuqwalaselwa kuphela kwimisebenzi leyo ingenako ukwenziwa ngabanye ootitshala.
  2. Ootitshala abaza kubambela abanye baya kunikwa ingqwalaselo kuphela xa abanye bengekho emsebenzini iintsuku zokusebenza eziyi-15 okanye ngaphezulu ngenxa yekhefu lokugula, elokuya kubeleka okanye ikhefu elilodwa.
  3. Ingcaciso ebhaliweyo ezathuzayo yoMphathi weSekethe (Circuit Manager) (CM) noMlawuli weSithili mayihambe kunye naso nasiphi isicelo esingachazwanga kwingongoma (b) elapha ngentla.
  4. I-CM noMlawuli weSithili mabaqale benze iinzame:
    1. zokuphanda ukuba ingaba kunako na ukwabelwana ngomsebenzi ngabo basebenzi bakhoyo;
    2. zokugaya utitshala ogqithisileyo kwinani elimiselweyo (excess educator) okanye ofumana ibhasari kwiilisti ezikhoyo;
    3. ukuxhasa ngemali inkcitho egqithisileyo esuka kwii-savings kwisithili eso.
  5. Kwiimeko apho utitshala ebhukishwe njengogulayo (off sick) kangangexesha elandisiweyo, inqununu kunye ne-CM mabagqithisele lo mba kwi-Independent Counselling and Advisory Services (ICAS) baze bona baqalise inkqubo yesicelo sokhubazeko ngenxa yempilo engentle (due to ill health).
  6. Makungaqeshwa titshala ubambela omnye ngaphandle kokufumaneka kwemvume kuqala esuka kulowo kugqithiselwe kuye amagunya (kuMlawuli weCandelo lokuGaya nokuKhetha aBasebenzi).
  7. Akusayi kubakho zicelo zitsha zootitshala ababambela abanye ziya kuvunywa ukuba baqeshwe ukususela nge-21 Novemba 2016 ngokunxulumene nekota yokugqibela yekhalenda yesikolo.
5. Intloko yeziko, ngokubambisene nebhunga lolawulo, mayingenise la maxwebhu alandelayo kwi-CM:

  1. Isicelo sekhefu lomqeshwa osisigxina;
  2. Ikopi yephepha likagqirha (medical certificate);
  3. Ingcaciso ebhaliweyo ezathuzayo ngeemeko ezikhethekileyo zokunikwa ibambela;
  4. Ifom yesicelo (DPA 01) eyenzelwe iinjongo zokuqeshwa kotitshala olibambela (fumana apha kuqhotyoshelwe ikopi yayo); kunye
  5. Nawo onke amaxwebhu afunekayo okuqeshwa komntu otyunjiweyo (nominee).
6. Esi sicelo masiqinisekiswe yaye kunikwe ingcebiso ngaso yi-CM (njengoko kubhaliweyo kuxwebhu lokwenza isicelo i-DPA 01).

7. Isicelo esizaliswe ngokupheleleyo masingeniswe kuMlawuli weCandelo lokuGaya nokuKhetha aBasebenzi ukwenzela ukuba sivunywe isicelo eso.

8. Bonke abaqeshwe njengootitshala ababambelayo baxhomekeke kwimvume yoMlawuli weCandelo lokuGaya nokuKhetha aBasebenzi. Makwenziwe onke amalinge okufumana imvume phambi kokuba kuqaliswe ngenkqubo yokuqesha ootitshala ababambela abanye.

9. Iziko elichaphazelekayo liya kusoleka ngako nakuphi ukuqeshwa kootitshala ababambelayo ukuba oko kwenzeke phambi kokuba kufumaneke imvume yoMlawuli wokuGaya nokuKhetha aBasebenzi.

10. Kucelwa wazise okukule ngcaciso imfutshane bonke abathathi-nxaxheba abachaphazelekayo ukuze bakuthathele ingqalelo.
