1. Kwiingxoxo zalo eziqhutywa qho nemibutho yeemanyano zabasebenzi (organised labour), iSebe leMfundo leNtshona Koloni (Western Cape Education Department (WCED)), liqaphele ukwanda kwenani lezikhalazo ezifunyenweyo ezimalunga nokusetyenziswa kwabasebenzi bakarhulumente kwisebe lezemfundo nokungavunyelwa kweemeko zengqesho ezithile kubasebenzi benkonzo karhulumente abakumaziko emfundo ngethuba nasemva kweeyure zomsebenzi eziqhelekileyo.

2. Ukwenzela ukuqinisekisa ukusetyenziswa ngokufanayo kwezi meko zengqesho kubaqeshwa benkonzo karhulumente kumaziko emfundo ngethuba nasemva kweeyure zomsebenzi, kubonakele kuyimfuneko ukuba kucaciswe imiba eliqela yomgaqo-nkqubo kule ngcaciso imfutshane.

3. Bonke abasebenzi benkonzo karhulumente baqeshwa ngokoMthetho weNkonzo kaRhulumente, 1994. Lo Mthetho ubonelela ngestraktsha sokuma nolawulo (organisation and adminstration) lwenkonzo karhulumente, ukulawulwa kweemeko zengqesho, amathuba okuba sezikhundleni, indlela yokuziphatha, umhlala-phantsi nokugxothwa enkonzweni kwamalungu enkonzo karhulumente nemiba enxulumene noko. Kusebenza iMimiselo yeNkonzo kaRhulumente, 2001, njengoko ifakelwe izilungiso, nefundwa kunye noMthetho weNkonzo kaRhulumente, oselukhankanyiwe -

  1. kubo bonke abantu abaqeshiweyo kunye nakumaziko alawulwa ngokwalo Mthetho; yaye
  2. ngokuxhomekeka kwimigaqo yalo Mthetho, nakubantu abaqeshwe kwezi nkonzo, kwii-arhente okanye kumaziko emfundo karhulumente, kuphela kangangoko ingaphikisani nemithetho elawula inkqubo yezengqesho yawo.
4. Oku kulandelayo sisishwankathelo semiyalelo echaphazelekayo engeemeko zengqesho ezisebenza kubasebenzi benkonzo karhulumente kumaziko emfundo.
4.1 Iiyure zomsebenzi
4.1.1 NgokoMthetho weeMeko zeNgqesho ezisiSiseko, 1998, (uMthetho 75/1998), (Basic Conditions of Employment Act, 1998 (Act 75/1998)), umqeshi akanakufuna okanye akanakuvumela umqeshwa asebenze ngaphezu-

  1. kweeyure eziyi-45 nakweyiphi na iveki;
  2. kweeyure ezisithoba nangaluphi na usuku ukuba umqeshwa usebenza iintsuku ezintlanu okanye ezimbalwa kunoko ngeveki; okanye
  3. kweeyure ezisibhozo nangaluphi na usuku ukuba umqeshwa usebenza ngaphezu kweentsuku ezintlanu ngeveki.
4.1.2 Liyure zomsebenzi eziqhelekileyo zomqeshwa zinokwandiswa ngemvumelwano kangangemizuzu eyi-15 ngosuku, kodwa kungabi ngaphezu kwemizuzu engama-60 ngeveki, ukwenzela ukuba umqeshwa omisebenzi yakhe ibandakanya ukwenzela uluntu inkonzo, aqhubeke nokwenza loo misebenzi emva kokugqiba iiyure zomsebenzi eziqhelekileyo.
4.1.3 Kwimeko apho kuthi kufuneke ukuba umqeshwa wenkonzo karhulumente okwiziko lemfundo enze iinkonzo emva kweeyure zomsebenzi eziqhelekileyo, kuya kusebenza isigqibo sexesha lomsebenzi kwinkonzo karhulumente. Esi sigqibo sexesha lomsebenzi masifundwe yaye sisetyenziswe kunye noMthetho weeMeko zeNgqesho ezisiSiseko, 1998 (uMthetho 75/1998), neMimiselo yeNkonzo kaRhulumente, 2001 esebenzayo ngoku, neemvumelwano zomqeshi nemibutho yeemanyano zabasebenzi ezisebenzayo njengangoku (prevailing collective agreements), kwakunye nemigaqo-nkqubo yephondo neyesebe emalunga nexesha lomsebenzi.
4.1.4 Bonke abaqeshwa benkonzo karhulumente baqeshwa ithuba leeyure eziyi-40 zeveki yomsebenzi. Ngako oko, bonke abaqeshwa benkonzo karhulumente abakumaziko emfundo mababesesikolweni iiyure zomsebenzi eziyi-40 ezimiselweyo nezisemthethweni ngeveki. Abasebenzi benkonzo karhulumente abanika inkxaso banokuthi, umzekelo, baqale kwangoko baze bahambe ngexesha elinye lokuphela kweeyure zesikolo o.k.t. baqale ngo-07H00 baze baphume ngo-15H30, ekuthi kunikwe imizuzu eyi-30 yekhefu lesidlo sasemini.
4.2 Ixesha lomsebenzi nembuyiselo
4.2.1 Apha kuqhotyoshelwe uxwebhu i-Determination and Directive on working time in the Public Service, olwenziwe nguMphathiswa weNkonzo kaRhulumente noLawulo njengesiHlomelo.
4.3 Amatheko abucala
4.3.1 Ngokwesiqendu 20 (2) soMthetho weZikolo zaseMzantsi Afrika, 1996, "ibhunga lolawulo linokuvumela ukusetyenziswa ngokufanelekileyo kweefasilithi zesikolo ukulungiselela abahlali neenjongo zeendibano zasekuhlaleni nozokunyusa ingxowa-mali yesikolo, ngokuxhomekeka kwezo meko zifanelekileyo, njengoko ibhunga lolawulo linokumisela, nezinokubandakanya ukubizwa kwentlawulo engena kwingxowa yesikolo" ["the governing body may allow the reasonable use of the facilities of the school for community, social and school fund-raising purposes, subject to such reasonable and equitable conditions as the governing body may determine, which may include the charging of a fee or tariff which accrues to the school".]
4.3.2 Kufunyenwe iqela lezikhalazo ezivela kubasebenzi benkonzo karhulumente abanika inkxaso zokuba kulindeleke ukuba babekhona ngethuba leeyure ezisemva kwezomsebenzi, ngeempelaveki okanye ngeeholide zikawonke-wonke xa kusenziwa amatheko abucala.
4.3.3 ISebe linqwenela ukucacisa imigaqo ethile emalunga nokusetyenziswa kwabasebenzi benkonzo karhulumente abanika inkxaso xa kusenziwa amatheko abucala:

  1. Abasebenzi benkonzo karhulumente abanika inkxaso baqeshwa ngokoMthetho weNkonzo kaRhulumente, 1994, yaye ke ngoko zonke iimeko zengqesho neemeko ezisebenza malunga nokuqeshwa kwabo ngurhulumente, kufanele zithotyelwe yaye zilandelwe ngqo ngamabhunga olawulo ezikolo.
  2. Makusetyenziswe olu xwebhu Determination and Directive on working time in the Public Service, olwenziwe nguMphathiswa weSebe leNkonzo kaRhulumente noLawulo, ukunika imbuyiselo abasebenzi abanika inkxaso abenza umsebenzi we-ovathayim ngokuzithandela bakucelwa ngamabhunga olawulo ezikolo okanye ziinqununu.
4.4 Umsebenzi ohlawulelwayo owenziwa ngaphandle kwenkonzo karhulumente
4.4.1 Iziqendu 30 no-31 zoMthetho weNkonzo kaRhulumente, 1994, njengoko ufakelwe izilungiso; neSahluko 2 seMimiselo yeNkonzo kaRhulumente, 2001, zazisa bonke abaqeshwa ngembopheleleko yabo yokufaka isicelo sokucela imvume kwiNtloko yeSebe ukuba banqwenela ukwenza umsebenzi ohlawulelwayo ngaphandle kwenkonzo karhulumente.
4.4.2 UMgaqo-nkqubo i-Western Cape Government's Transversal Human Resource Management Policy ulawula ukwenziwa komsebenzi ohlawulelwayo ngabaqeshwa beSebe iWCED ngaphandle kwenkonzo karhulumente. Lo mgaqo-nkqubo ufakelwe izilungiso, yaye umgaqo-nkqubo ohlaziyiweyo waphunyezwa ukususela nge-1 Septemba 2012. 4.5 Ikhefu labasebenzi abangezotitshala ezikolweni, kumaziko oqeqesho nakwiihostele
4.5.1 Luqhotyoshelwe apha uxwebhu i-Determination and Directive on Leave of Absence in the Public Service (August 2012). Lo myalelo umalunga nekhefu eliqhelekileyo, ikhefu lokugula kwakunye nexesha lokukhululwa emsebenzini (time off).

4.6 Ukusetyenziswa kwabasebenzi benkonzo karhulumente ezikolweni
4.6.1 Kufunyenwe iqela lezikhalazo ngokumalunga nokusetyenziswa kwabasebenzi benkonzo karhulumente ezikolweni kwimisebenzi engeyiyo leyo babeqeshelwe yona. Ngokungqinelana neCandelo 111, 1.1 leMimiselo yeNkonzo kaRhulumente, 2001, kufuneka iSebe limisele iinkcazo zemisebenzi (job descriptions) namagama ezithuba zomsebenzi (job titles) kwisithuba ngasinye kunye/okanye kwiqela lezithuba yaye ezi zinto mazimane ziqwalaselwa qho. Makusebenze oku kulandelayo kwinkcazo yomsebenzi:

  • makuboniswe imfuneko yomsebenzi lowo;
  • makuboniswe iinkalo eziluxanduva nezifuna kwenziwe loo msebenzi; nokuba
  • makusekelwe kumsebenzi oza kwenziwa (be job-based), kungabi yindlela yokusebenza (not performance based).
4.6.2 Ngokusekelwe kwimibuzo efunyenwe kwiimanyano ngeemanyano ezimele abasebenzi benkonzo karhulumente, kukho ubungqina bokuba kusetyenziswa abasebenzi benkonzo karhulumente abanika inkxaso kumaziko emfundo nabathi basetyenziswe yaye bayalelwe ukuba benze umsebenzi ongenguwo lowo ucaciswe kwiinkcazo zemisebenzi zezithuba abaqeshelwe zona. Kwenziwa iinkcazo zomsebenzi jikelele (generic job descriptions) ngokumalunga nabasebenzi benkonzo karhulumente abakumaziko emfundo nakwiihostele. Kucelwa nifunde iSetyhula 0033/2004 ngokumalunga nezi zithuba zilandelayo zenkonzo karhulumente:

  • Umsebenzi jikelele
  • Iforimani;
  • Umabhalane
  • Isuphavayiza yasehostele eyintloko;
  • Isuphavayiza yasehostele; kunye
  • nomsebenzi oncedisa kwindawo yokuhlala.
4.7 Ukuthuthwa ngezithuthi ukusuka kwindawo yokuhlala neyomsebenzi
4.7.1 Ngokungqinelana noMyalelo i-Provincial Directive on Transport luxanduva lwabaqeshwa ukuzilungiselela indlela yezothutho lwabo ukusuka kwindawo yokuhlala neyomsebenzi kwakunye neendleko zoko. Nakuba kunjalo, iimanyano zabasebenzi zazise iSebe ukuba kwiimeko ezithile abaqeshwa ekufuneka benze iinkonzo ngeeyure zasemva kwezomsebenzi ababuyiselwa ngeendleko zeehambo ezilolu hlobo. ISebe iWCED linqwenela ukucebisa iinqununu namabhunga olawulo ezikolo ukuba, lo gama kungekho migqaliselo okanye migaqo-nkqubo enyanzelisa umqeshi ukuba ambuyisele umqeshwa ngazo naziphi na iindleko zezothutho, maziyithathele ingqalelo ii-SGBs neenqununu into yokuhlawula inkcitho yabasebenzi abaye bafumana imvume yokuba benze inkonzo ngexesha elingaphaya kweeyure zomsebenzi eziqhelekileyo.
