Section 6A of the Employment of Educators Act (EEA), 1998 (Act 76 of 1998) provides for the appointment of newly qualified educators in a permanent capacity without the substantive post having had to be advertised in a vacancy list.
A newly qualified educator is a final year student and/or a qualified educator who qualified in the past two years and has never had the opportunity of occupying an educator's post in the employ of the state. |

The appointment to a permanent post as envisaged above is at the discretion of the head of a provincial education department. |

Newly qualified educators may therefore be (immediately) appointed in a permanent capacity without the advertisement of the post, on the following conditions. |
3.1 |
The permanent appointment must be made to a vacant substantive Post Level 1 post and the post must reflect in the new educator staff establishment of the school for 2015. |
3.2 |
The newly qualified educator must:
- be at least a final year student with a view to complete their qualification by the end of 2014, thus being professionally qualified for the education profession by 01 January 2015;
- meet the inherent requirements of the post to which the appointment will be made; and
- be registered with the South African Council of Educators (SACE).

This minute also allows for the following policy measures: |
5.1 |
Where a new post has been granted to an institution, via the revised staff establishment for 2015, such a post may be permanently filled according to the measures set out above. |
5.2 |
School governing bodies and principals can request a list of Funza Lushaka Bursary holders from the Recruitment and Selection component to recruit and select suitable candidates for appointment. |
6. |
Principals are requested to ensure that this minute is brought to the attention of their school governing bodies and educators. |
7. |
This minute is applicable to ordinary public schools and special public schools. |
