1. Inkqubo yokuqeshwa kukatitshala osesikolweni njengobambeleyo kwisithuba esiphezulu nesixhaswa ngemali nengcaciso ngentlawulo yesibonelelo sokubambela kwiimeko ezinjengezi, yacaciswa kwiSetyhula 0045/2002 nakwiSetyhula 0031/2003. Le ngcaciso imfutshane yongezelela ingcaciso kwimiqathango yee setyhula zangaphambili.

2. Ezi nkqubu zilandelayo ngokwemigqaliselo yezi Zigqibo zeBhunga leMfundo lezoBudlelane eMsebenzini (ELRC Collective Agreements): 8/2001, 8/2002 no-1/2008, mayilandelwe, xa kutyunjwa ootitshala abasezikolweni ukuba baqeshwa njengababambeleyo kwizithuba eziphezulu ezingenamntu nezixhaswa ngemali:
2.1 Imigaqo ngokubanzi
2.1.1 Utitshala ongqinelanayo neemfuno ezimiselweyo kumhlathi 2(2) weSahluko B kwiMigaqo yoLawulo lwaBasebenzi (Personnel Administration Measures), uya kuqeshwa ngencwadi ebhaliweyo, ngumqeshi, ukuba abambele kwisithuba esichaphazelekayo.

2.1.3 Isibonelelo sokubambela ngumahluko phakathi kwenotshi yomvuzo womqeshwa awufumana ngelo xesha nenotshi yomvuzo womntu oqalayo kwisithuba esiphezulu esingenamntu nesixhaswa ngemali.
2.1.4 Ukuba umqeshwa ukwinotshi yomvuzo (kubandakanywa inotshi eyenzelwe yena buqu (personal notch)) engaphezulu kwenotshi yomvuzo womntu oqalayo kwisithuba esiphezulu esingenamntu nesixhaswa ngemali aqeshwe kuso, isibonelelo sokubambela siya kuba ngumahluko phakathi kwenotshi yomvuzo wakhe ngelo xesha nenotshi yomvuzo elandelayo ephezulu echaphazelekayo kwisithuba esiphezulu esingenamntu, ngokuxhomekeka ekubeni ukho umahluko.
2.1.5 Apho isithuba sokubambela siba sisithuba esiphezulu esiza kuba sesikolweni okanye kwi-ofisi ethe yasuswa (geographically removed) kwindawo asebenza kuyo ngoku umqeshwa, intlawulo efanelelulayo yokuhlala nenkxaso yesithuthi sokuphangela esiyisubsistence ne travel allowance, iyakuqwalaselwa.
2.1.6 Utitshala uya kwenza yonke imisebenzi emalunga nesithuba eso ngelo xesha aqeshelwe sona.

2.1.8 Intloko yecandelo inqununu mayazise umqeshwa ngencwadi ebhaliweyo ngokuqeshwa kwakhe kwisithuba esiphezulu esingenamntu nesixhaswa ngemali njengobambeleyo yaye umqeshwa lowo makakwamkele okanye akwale ukuqeshwa kwakhe ngencwadi ebhaliweyo.
2.1.9 Isibonelelo sokubambela asixhuzulwa mali yomhlala-phantsi (is non-pensionable).
2.2 Izithuba eziphezulu ezingenamntu nezixhaswa ngemali
2.2.1. Isibonelelo sokubambela siya kuhlawulwa kuphela xa utitshala ebambele:
2.2.1.1 kwisithuba esiphezulu esixhaswa ngemali yaye
2.2.1.2 Xa ithuba lokuqeshwa kwesi sithuba lingaqhawulwanga yaye lilide ngaphezu kweeveki ezi-6, kodwa lingabi ngaphezu kweenyanga ezilishumi elinambini. Isithuba e so kufuneka sipapashwe sizaliswe zingadlulanga iinyanga eziyi-12 zokungabinamntu.
2.2.1.3 Intlawulo eyimbuyiselo (compensation) iya kubuyiselwa emva (will be backdated) iqale ngo mhla utitshala awaqala ngawu ukubambela ngokuxhomekeka ekubeni intlawulo yokuqala yenziwa ngenyanga elandela ukugqitywa kweeveki ezintandathu ekubhekiselelwe kuzo kumhlathi 2.2.1.2 apha ngentla.
2.3 Ukubambela kwisithuba esiphezulu apho utitshala aqashwe isigxina engekho
2.3.1 Isibonelelo sokubambela siya kuhlawulwa kutitshala kuphela xg ebambele kwisithuba sotitslal oqashwe isigxina ongekhoyo, kangangethuba elide kuneeveki eziyi-12, kodwa lingadluli kwiinyanga eziyi-12 ngenxa yesinye sezi zizathu zilandelayo:
2.3.1.1 Ukwikhefu lokuya kubeleka;
2.3.1.2 Ukwikhefu lokugula;
2.3.1.3 Unqunyanyisiwe emsebenzini;
2.3.1.4 Usekondiwe;
2.3.1.5 Ukwikhefu lokugula elivunyiweyo
2.3.2 Intlawulo eyimbuyiselo (compensation) iya kubuyiselwa emva (will be backdated) iqale-ngo mhla utitshala awaqala ngawo ukubambela ngokuxhomekeka ekubeni intlawulo yokuqala yenziwa ngenyanga elandela ukugqitywa kweeveki ezilishumi elinambini ekubhekiselelwe kuzo kumhlathi 2.3.1(b) apha ngentla.

3. Inkqubo yokutyumba;
3.1 Inqununu okanye intloko yeziko mayityumbe amagama ootitshala.
3.2 Ibhunga lolawulo lesikolo liya kucelwa ukuba linike iingcebiso kumqeshi ngotitshala ochongwe ngumphati okanye inqununu wesikolo, oza kuqeshwa abambele kwisithuba esiphezulu esingenamntu nesixhaswa ngemali.
3.3 Inqununu okanye intloko yeziko mayingqinisise ukuba ukutyunjwa kwalowo kuyangqinelana nemigqaliselo yaye iqinisekise ukuba onke amaxwebhu aqhotyoshelwe, phambi kokunika iingcebiso nokuthumela isicelo kumphathi weze-IMG.
3.4 Le fom yokwenza izicelo iqhotyoshelweyo yesibonelelo sokubambela (DHM 01) mayingeniswe kuMlawuli weCandelo loLawulo Iwezabasebenzi ukulungiselela ukusingathwa kwentlawulo yesibonelelo sokubambela. 3.5 Igunya lokuvuma ukuqeshwa kootitshala ababambeleyo abakumaziko lithweswe igosa elikwiSithuba seNqanaba 5 (uMphathi weze-IMG) okwi-ofisi yesithili semfundo iziko eliphantsi kwaso. Makwenziwe konke okusemandleni ukufumana imvume phambi kokuqalisa kukatitshala oqeshwe njengobambeleyo.
3.6 Isithuba utitshala abambele kuso masipapashwe yaye sizaliswe kwithuba leenyanga eziyi-12 zokungabinamntu kwaso ngaphandle kwalapho lowo ukwisithuba kwangaphambili (original incumbent) ukwikhefu lokuya kubeleka, lokugula, unqunyanyisiwe okanye usekondiwe.
3.7 Nantoni na engahambelani nesi sigqibo, mayikhatshwe yimbalelwano enika isizathu ezivakalayo.
3.8 Abaqeshwa mabaqaphele ukuba ukuqeshwa kwabo njengababambeleyo akubaniki lungelo lokuba balindele ukuqeshwa isigxina ngokusemthethweni kwisithuba sakuba nje sipapashiwe.

4. Kucelwa wazise bonke abaqeshwa okukule ngcaciso imfutshane ukuze bakuthathele ingqalelo.
