1. Background

In terms of the stipulations of the Education Laws Amendment Act (Act 50 of 2002), it is the responsibility of the school principal to prepare and submit to the Head of Department (HOD) an annual report on:

  • the academic performance of the school in relation to the minimum outcomes and standards determined by the Minister, and
  • the effective use of resources.

This annual report must be tabled at a school governing body meeting and presented to the HOD, who approves or returns it to the school, with recommendations, if necessary.

The amendment to Section 20 of the South African Schools Act (SASA) (Act 84 of 1996) requires relevant role-players to adhere to any actions taken by the HOD to address the incapacity of a principal or educator to carry out his or her duty effectively.

Additions to the SASA (Sections 58B and 58C) also require the HOD to identify under-performing schools annually and to give written notice to such schools. This notice, therefore, serves to implement the requirements of the SASA.

2. Underperformance by schools
2.1 After due consideration of the annual Grade 3 and/or Grade 6 academic results for the period 2006 to 2008, the HOD has noted that certain schools have periodically achieved results below 50%. Such schools are regarded as having under-performed.
2.2 The results of primary and combined schools that did not achieve results above 50% during the period 2006 to 2008 have been posted on CEMIS under the heading Assessment - School Performance. If no record of results appears for your school, it means that your school achieved results above 50% during this period.
