1. The Western Cape Education Department was requested by the Department of Basic Education to inform all schools in the Western Cape Province of the revocation and removal of the Measures for the Prevention and Management of Learner Pregnancy.
2. The Department of Basic Education published the Measures for the Prevention and Management of Learner Pregnancy in 2007 as a response to the growing problem of learner pregnancy and the need to provide guidance to schools.
3. However, these Measures were found to be in breach of the Constitution, in particular, a learner’s right to basic education as learners were being expelled on account of the Measures. The Measures were also found to discriminate unfairly on the basis of gender and pregnancy.
4. The Department of Basic Education revoked these Measures in 2011 and therefore no longer apply.
5. Please be informed that the Western Cape Education Department’s Policy on the Management of Learner Pregnancy which was sent to schools under cover of Circular 121/2003 dated 13 May 2003, still applies.
6. Please bring the content of this circular to the attention of all educators and parents of learners.
