1. Umqeshwa ngamnye unelungelo lokufaka isikhalazo kwisuphavayiza yakhe ukuba umqeshwa akanelisekanga sisenzo esisemthethweni (official act) okanye esiyimposiso esenziwe ngumqeshi (omission by the employer) esichaphazela umqeshwa kubudlelane kwezengqesho.

2. Sifumanise ukuba azilandelwa iinkqubo ezithile ezibalulekileyo xa kusingethwe izikhalazo.

3. Abaphathi mabayiqwalasele inkqubo echanekileyo namaxesha amisiweyo acaciswe kwimithetho echaphazelekayo (relevant legislation) ukwenzela ukuba kugcinwe ubudlelane kwezengqesho obuhle nobushushu kwiimeko ezingqonge umsebenzi.

4. Kunikwe apha ngasezantsi isishwankathelo seenkqubo nemiba ebalulekileyo emalunga nezikhalazo:
4.1 Ootitshala

Imigaqo neenkqubo zokusingatha izikhalazo zabasebenzi abangootitshala zicaciswe kwiSahluko H se-Personnel Administrative Measures of the Employment of Educators Act, 1998.

  1. Phambi kokuba imiba ekungavanwa ngayo ithathwe njengezikhalazo ezisemthethweni, makwenziwe amalinge anyanisekileyo okuba sisonjululwe nasiphi na isikhalazo ngodliwano-ndlebe buqu phakathi komqeshwa okhalazayo nenqununu yesikolo.

  2. Ngethuba lale nkqubo, akukho zirekhodi ziya kugcinwa ezimalunga neengxoxo, nenkqubo ayisayi kudlelelela naliphi na iqela elichaphazelekayo.

  3. Xa oku kungaphumeleli, utitshala unelungelo lokufaka isikhalazo esisemthethweni kwinqununu yesikolo ngencwadi ebhaliweyo zingadlulanga iintsuku zekhalenda eziyi-90 ukususela kumhla ekwenzeka ngawo isenzo okanye imposiso ekhokelela kwisikhalazo.

  4. Inqununu yesikolo iya kuthumela iikhomenti zayo ngesikhalazo, kunye nayo yonke ingcaciso efanelekileyo, kumlawuli wesithili ochaphazelekayo zingadlulanga iintsuku ezi-5 zomsebenzi emva kokufumana isikhalazo esisemthethweni ngencwadi ebhaliweyo.

  5. Umlawuli wesithili, okanye lowo kudluliselwe kuye amagunya, uya kuthi zingadlulanga iintsuku ezi-5 zomsebenzi zokufumana isikhalazo, azame ukusisombulula isikhalazo eso aze emva koko asazise isigqibo sakhe ngencwadi ebhaliweyo kuwo onke amaqela achaphazelekayo.
4.2 Ootitshala abasezi-ofisini

Ukuba loo mqeshwa unesikhalazo ngutitshala ose-ofisini, isuphavayiza yomqeshwa mayisingathe isikhalazo eso ngendlela efanayo naleyo ilandelwa yinqununu.

4.3 Abasebenzi benkonzo karhulumente

Imigaqo neenkqubo zokusingatha izikhalazo zabasebenzi benkonzo karhulumente zimiselwe kwi-Public Service Co-ordinating Bargaining Council Agreement No.14 of 2002 neyayipapashwe kwiGazethi kaRhulumente No. 25209 nge-25 Julayi 2003. La maxwebhu makafundwe kunye neSetyhula yeSebe iWCED 230 yango-2003.

  1. Umqeshwa onesikhalazo uneentsuku zekhalenda eziyi-90 ukususela ngaloo mhla wesenzo okanye wemposiso ekhokelele ekubeni kufakwe isikhalazo. Oku makwenziwe ngokuthi kubhalwe kuzaliswe iCandelo A nesiqendu sokugqibela seCandelo B lefom emiselweyo.

  2. Umlawuli okanye intloko yeziko echaphazelekayo ngumqeshwa otyunjiweyo (designated employee) owenza lo msebenzi yaye makazalise isiqendu sokuqala leCandelo C lefom emiselweyo. Umlawuli makenze konke okusemandleni akhe ukusombulula isikhalazo ngokukhawuleza.

  3. Ukuba umqeshwa okhalazayo akanelisekanga sisiphumo, umqeshwa otyunjiweyo (designated employee) emva koku makanike iingcebiso kuMphathi oneGunya loLawulo (Executive Authority) (uMphathiswa weMfundo wePhondo)) ukwenzela ukuba kuthathwe isigqibo sokugqibela.

  4. Kubaluleke gqitha ukuqaphela ukuba isikhalazo masisonjululwe kwiintsuku eziyi-30 zokufakwa kwesikhalazo ngumqeshwa okhalazayo. Ithuba elikhankanyiweyo lidibanisa nasiphi na isikhalazo esisiwa kuMphathi oneGunya loLawulo ngokomhlathi 4.3(iii) olapha ngasentla.
5. Umqeshwa otyunjiweyo (designated employee) makathumele ngefeksi amaxwebhu esikhalazo achaphazelekayo kuMlawuli weCandelo lezoBudlelane eMsebenzini (D:LR) kwiintsuku ezi-3 akuba ewafumene kumqeshwa, ukwenzela ukuba isikhalazo sibhaliswe kwiPESALI. Makuqatshelwe ukuba, ngokubhekisele kudluliselo lwamagunya ngokusemthethweni (legal delegations), iCandelo lezoBudlelane eMsebenzini (D:LR) alinagunya lokusingatha izikhalazo ngaphandle nje kokwenza umsebenzi wokubeka esweni kuphela.

6. Nakuba kunjalo, iCandelo lezoBudlelane eMsebenzini (D:LR) malaziswe ngesiphumo sesikhalazo ngasinye ukulungiselela injongo yokunika ingxelo kwiKhomishoni yeNkonzo kaRhulumente (Public Service Commission), kwiSebe leNkonzo kaRhulumente nezoLawulo (Department of Public Service and Administration) nakwiSebe leNkulumbuso (Department of Premier)). Ngaphezu koko, ukuphethwa kokusingathwa kwesikhalazo ngasinye kufuna ukuba kubhalwe kwiPESALI.

7. Makugxininiswe ukuba ukuthotyelwa kwenkqubo ngokufanelekileyo kubaluleke gqitha ekusombululeni isikhalazo nokuthintela uxambuliswano. Kucelwa uqaphele ukuba ukungasonjululwa kwezikhalazo kunokukhokelela ekubeni abaphathi babekwe ityala lokuziphatha kakubi.

8. Kucelwa wazise okukule setyhula bonke abaphathi neesuphavayiza eziphantsi kolawulo lwakho ukwenzela ukuba bakunike ingqwalaselo.
