1. Inkqubo yolawulo loMgaqo weeveki ezisi-8 icaciswe kwiSetyhula 0027/2006 yowe-8 Juni 2006.

2. Ukwenzela ukuqinisekisa usetyenziso ngendlela eyiyo kwalo mgaqo, ziyakhunjuzwa iinqununu, ootitshala nabasebenzi benkonzo karhulumente ngoku kulandelayo, okuqulethe eyona miba ibalulekileyo ekwiSetyhula 0027/2006 yomhla wesi-8 Juni 2006:
2.1 Ngokwemigaqo ekhoyo ngoku yekhefu lokugula labasebenzi benkonzo karhulumente (public service), njengoko ikuMyalelo ongeKhefu lokuNgabikho eMsebenzini labakwiNkonzo kaRhulumente (Directive on Leave of Absence for the Public Service) (emva koku obizwa ngokuba ngumyalelo (directive)),

  1. umqeshwa (oku kukwabhekisa nakutitshala ukulungiselela iinjongo zale setyhula) unelungelo lokufumana iintsuku zomsebenzi eziyi-36 zekhefu lokugula eliqhelekileyo efumana umvuzo opheleleyo ngomjikelo oyiminyaka emithathu (three-year cycle),

  2. kungakhathaliseki nokuba zingaphi iintsuku ezisetyenzisiweyo, kufuneka umqeshwa angenise incwadi kagqirha yokugula (medical certificate) ekhutshwa ngugqirha alisiweyo novunyiweyo (registered and recognised practitioner) ngethuba ngalinye leentsuku ezintathu okanye ezingaphezu koko ezilandelelanayo zekhefu lokugula elisetyenzisiweyo, ecacisa ubude bethuba elo lokungabikho kwakhe. Nakuba kunjalo, kwiimeko apho kuqatshelwe isiqhelo esithile sokusetyenziswa kwekhefu lokugula (pattern in the use of sick leave), unokucelwa umqeshwa ochaphazelekayo, nokuba ngaba ngamathuba okungabikho angaphantsi kweentsuku ezintathu zomsebenzi, ukuba angenise incwadi kagqirha yokugula.
2.2 Kwenziwe isibonelelo kwiSahluko 3, isiqendu 23 (1) soMthetho weeMeko zeNgqesho ezisiSiseko, 1997 (Basic Conditions of Employment Act, 1997) somgaqo weeveki ezisi-8. Esi siqendu sicacisa ukuba akukho mfuneko yokuba umqeshi amhlawule umqeshwa ukuba:

  1. umqeshwa uye akabikho emsebenzini ithuba elingaphezu kweentsuku ezimbini zilandelelana, okanye

  2. ngaphezu kwamatyeli amabini (more than two occasions) ngethuba leeveki ezisibhozo yaye, umqeshi akwenza isicelo, umqeshwa angezi nencwadi kagqirha yokugula ecacisa ukuba umqeshwa lowo ubengenako ukusebenza ngelo thuba lokungabikho kwakhe ngenxa yokugula okanye yokwenzakala.
2.3 UMphathiswa weNkonzo kaRhulumente noLawulo (Minister for Public Service and Administration) wenze isigqibo sokuba lo myalelo ongekhefu lokugula okhoyo njengangoku wabasebenzi benkonzo karhulumente mawunatyiswe ukuze ubandakanye nomgaqo weeveki ezisi-8 nokuba kusetyenziswe kwakhona lo myalelo ungomnye ulandelayo:

  1. Umqeshwa othe ngethuba lekhefu lokugula eliqhelekileyo eliziintsuku eziyi-36 akabikho emsebenzini ngaphezu kwamatyeli amabini ngethuba leeveki ezisibhozo, kungakhathaliseki bude bethuba lokugula okanye lokwenzakala kwakhe, makangenise incwadi kagqirha yokugula ecacisa ukuba umqeshwa lowo ubengenako ukusebenza ngelo thuba lokungabikho kwakhe ngenxa yokugula okanye yokwenzakala.

  2. Xa ezalisa ifom yekhefu, umqeshwa makabhale atsho ukuba, apho angawuthobelanga uMgaqo weeveki ezisi-8, umqeshi makasebenzise iintsuku anazo zekhefu leholide (vacation leave credits) okanye, ukuba akanazo iintsuku zekhefu leholide, makusetyenziswe ikhefu elingahlawulelwayo (leave without pay).

  3. Ithuba leeveki ezisi-8 liya kuba lithuba lekhalenda yaye liya kuqala ukusebenza ngokusu lokuqala lokungabikho komqeshwa emsebenzini ngenxa yokugula okanye yokwenzakala. Naluphi na usuku olulandelayo lokungabikho emsebenzini (naziphi na iintsuku ezilandelayo zokungabikho emsebenzini) ngenxa yokugula okanye yokwenzakala emva kwethuba elikhankanywe apha ngasentla, maluthathwe ke ngoko ngokuba lusuku lokuqala lethuba leeveki ezisi-8 ezilandelayo.
3. Kucelwa wazise okukule setyhula bonke abaqeshwa abaripota kuwe ukuze bakuthathele ingqalelo.
