1. This circular is directed at schools who have been allocated the function, in terms of Section 21 (1c) of the SA Schools Acts, 1996 (Act 84, 1996), of arranging and paying for learner transport services for their schools, with financial assistance from the Western Cape Education Department (WCED).
2. The WCED has provided those schools with a bid and contract form, which was compiled in consultation with the legal representatives of learner transport contractors. This form must be used both for the submission of a bid and for the concluding of a contract with the provider of a learner transport service. As regards the contract, the form specifies all the transport requirements, contract conditions and penalties.
3. However, it has come to our attention that some schools are not using the bid and contract form.
4. The WCED wishes to remind all the schools concerned that use of the attached bid and contract form for learner transport is compulsory. Schools may augment the content of the form, but the minimum requirements on the bid and the contract form must be adhered to.
5. The corporate service advisers and circuit team managers at the district office will be monitoring the compulsory use of the bid and contract form and, for audit purposes, schools are therefore required to file evidence of the use of this form.
6. Schools who experience problems with the interpretation of clauses contained in the bid and contract form may seek assistance from the Deputy Director: Corporate Services at their district office.
7. Kindly bring the content of this circular to the attention of all concerned.
