1. Injongo yale ngcaciso imfutshane kukwenza abaqeshwa baqaphele iimfuno ezimalunga namathuba okunika inothisi yokushiya inkonzo (resignation notice periods) njengoko ecacisiwe kwimiMiselo yeNkonzo kaRhulumente (Public Service Regulations) nakulo mgaqo-nkqubo Transversal Policy on Appointments, Promotions and Termination of Service of the Provincial Government of the Western Cape, nakuMthetho wezeNgqesho yooTitshala ka-1998 (UMthetho 76 ka-1998). Kubalulekile ukulandela ngqo la mathuba okunika inothisi yokushiya inkonzo acacisiweyo, ukwenzela ukunika ixesha lokuqaliswa kwazo zonke iinkqubo zezolawulo zide ziye kugqitywa kwangexesha.

2. Amathuba okushiya inkonzo ngokumalunga nabaqeshwa abaqeshwe phantsi koMthetho weNkonzo kaRhulumente, ka-1994

ImiMiselo yeNkonzo kaRhulumente ka-2001 icacisa oku kulandelayo malunga namathuba okushiya inkonzo:

Umqeshwa angayishiya inkonzo karhulumente, kwaye ngenxa yaloo njongo, ngaphandle kokuba kuvunyelwene ngandlela yimbi namagunya alawulayo, uya kuthi
(a) kwimeko yakhe nawuphi na umqeshwa ohlawulwa qho ngenyanga, anike inothisi ebhaliweyo yokushiya inkonzo ubuncinane yenyanga enye;
(b) kwimeko yakhe nawuphi na umqeshwa ongxungxileyo (casual employee) othe waqeshwa okwethuba elingaphantsi kweeveki ezine; anike inothisi yokushiya inkonzo ubuncinane yeveki enye okanye;
(c) kwimeko yakhe nawuphi na umqeshwa ongxungxileyo (casual employee) othe waqeshwa okwethuba elingaphezu kweeveki ezine, anike inothisi yokushiya inkonzo ubuncinane yeveki ezimbini.
[An employee may resign from the public service, and for that purpose, unless otherwise agreed with the executing authority, shall -
(a) in the case of any employee paid monthly, give at least one month's written notice of resignation;
(b) in the case of any casual employee who has been employed for less than four weeks; give at least one week's notice of resignation or;
(c) in the case of any casual employee who has been employed for more than four weeks, give at least two weeks' notice.]

5.12 Ukushiya inkonzo;
5.12.2 Umqeshwa unokushiya inkonzo kaRhulumente wePhondo leNtshona Koloni nanini na, ngokuxhomekeka ekubeni unika inothisi ebhaliweyo yenyanga yekhalenda enye yaye phantsi kwezo meko njengoko zisebenza ngokumalunga nayo nayiphi na imvumelwano yezengqesho (contractual agreement) engaba iyasebenza kuloo meko yakhe ngomhla wokushiya inkonzo (umz imiqathango yebhasari). Nangona kunjalo umqeshi angathi ngokwengqiqo yakhe alamkele elo thuba lifutshane lenothisi kwiimeko ezizodwa;
5.12.4 Akuba umqeshwa enike inothisi yokushiya inkonzo, aze anqwenele ukuyirhoxisa inothisi yokushiya kwakhe inkonzo, ukuvunywa kokurhoxisa ukushiya kwakhe inkonzo ngethuba lenothisi kungenziwa kuphela ngevume yabasemagunyeni abafanelekileyo.

Ngokubhekiselele ku-5.12.4 ngasentla nakwimeko ye-WCED: Abaphathi abakhulu (kwinqanaba lomlawuli okanye kwisikhundla esilingana neso kwanesingaphezulu, "osemagunyeni ofanelekileyo" ubhekiselele kwiNtloko yeSebe leMfundo; Kubaqeshwa abangaphantsi kwinqanaba labaphathi abakhulu "osemagunyeni ofanelekileyo" ubhekiselele kumlawuli lowo kuziswa kuye ingxelo.

5.12 Resignation;
5.12.2 An employee may resign from the WCPA at any time, subject to the giving of one calendar month's written notice, and on such conditions as may be applicable in terms of any contractual agreement which may apply at the date of resignation (e.g. bursary obligations). The employer may however in its discretion accept a shorter period of notice in exceptional circumstances;
5.12.4 Once an employee has given notice of her / his resignation, and she / he wishes to withdraw her / his resignation, approval for the reversal of the resignation during the notice period may only be granted with the approval of the appropriate authority.

3. Amathuba okushiya inkonzo ngokumalunga nootitshala abaqeshwe ngokoMthetho wezeNgqesho yooTitshala ka-1998

IGatya 15 leSahluko 4 soMthetho wezeNgqesho yooTitshala ka-1988 licacisa oku kulandelayo:

Ukushiya inkonzo
15. (1) Utitshala angayishiya inkonzo ngokuthi anike inothisi ebhaliweyo yeentsuku ezingama-90 yokushiya inkonzo okanye inothisi yethuba elifutshane kunoku njengoko umqeshi enokukuvuma oko ngokwesicelo sikatitshala;
(2) Ukuba igama likatitshala liyacinywa kwirejista yootitshala egcinwe yi-South African Council for Educators, utitshala uya kuthathwa njengoyishiyileyo inkonzo ukususela ngomhla olandela kanye emva kwalowo igama lakhe licinywe ngawo kwirejista, kungakhathaliseki nantoni na engaba ichasene noku equlethwe kulo Mthetho.
Resignations
15. (1) An educator may resign by giving 90 days' notice in writing or such shorter notice as the employer may approve at the request of the educator;
(2) If the name of an educator is struck off the register of educators kept by the South African Council for Educators, the educator shall, notwithstanding anything to the contrary contained in this Act, be deemed to have resigned with effect from the day following immediately after the day on which the educator's name was so struck off.
