2. Njengoko kucacisiwe kwezi setyhula zikhankanywe apha ngasentla, umqeshwa (ongutitshala okanye ongumsebenzi wenkonzo karhulumente) unelungelo leentsuku eziyi-36 zekhefu lokugula (sick leave) kumjikelo weminyaka emithathu (umjikelo okhoyo ngoku ususela ku-2010 ukuya ku-2012). Lonke ikhefu lokugula eligqithileyo kwiintsuku zekhefu lokugula eliqhelekileyo (normal sick leave) lithathwa njengekhefu lokungaphili okwethutyana (as temporary incapacity leave), yaye ikhefu elilolu hlobo malenzelwe isicelo kwifom emiselweyo. Abaqeshwa nangoku basenza izicelo zekhefu lokungaphili okwethutyana kwifom yesicelo sekhefu uZ1, ekuyifom esebenza kuphela kwikhefu lokugula eliqhelekileyo. Makungasetyenziswa ifom yesicelo sekhefu uZ1 kwikhefu lokungaphili okwethutyana (temporary incapacity leave).

3. Njengoko kutshiwo kwimihlathi 3 no-5 yeSetyhula 0045/2006, abaqeshwa mabangenise isicelo sekhefu lokungaphili okwethutyana ngendlela emiselweyo zingekapheli iintsuku ezi-5 ukusuka kusuku lokuqala lokungabikho.

4. Ukuba umqeshwa akaphumeleli ukungenisa isicelo sekhefu lokungaphili okwethutyana zingekapheli iintsuku ezi-5, kuya kusebenza ke ngoko le nkqubo ilandelayo:
4.1 Umphathi womqeshwa okanye isuphavayiza yomqeshwa mayazise isebe kwiintsuku ezimbini (2) zomsebenzi ukuba isicelo sekhefu lokungaphili okwethutyana asifikanga. Eli thuba lekhefu lokugula liya kuthi ke ngoko litsalwe kwikhefu lonyaka (annual leave) (ngemvume yomqeshwa) kunye/okanye libe likhefu elingahlawulelwayo, ukuba azanelanga iintsuku anazo zekhefu lonyaka okanye zekhefu eligcinelwe ukuze lihlawulwe (annual or accumulated leave credits).
4.2 Ukungaphumeleli komqeshwa ukungenisa isicelo sekhefu lingekapheli ithuba elicacisiweyo, okanye ukungaphumeleli komphathi okanye kwesuphavayiza ukulawula ikhefu ngendlela eyiyo nefanelekileyo, kuya kujongwa njengesenzo esibi kakhulu yaye kuya kucingwa ngokuthatha amanyathelo oluleko.

5. Kunyanzelekile ukuba umenzi-sicelo azalise yaye angenise iifom ezisemthethweni (statutory application forms) zesicelo sekhefu lokungaphili kunye/okanye zesicelo sekhefu lokuthatha umhlala-phantsi ngenxa yokungaphili (incapacity leave and/or ill health retirement) (o.k.t. IziHlomelo A, B okanye E), kwakunye nengcaciso ethile yokongeza (o.k.t. ekagqirha nencedisayo, (i.e. medical and ancillary)). Apho amaxwebhu anyanzelekileyo alolu hlobo kunye/okanye ingcaciso efunekayo inganikwanga, eso sicelo sekhefu lokungaphili kunye/okanye sekhefu lokuthatha umhlala-phantsi ngenxa yokungaphili siba sisicelo sekhefu esingenakusebenza emthethweni nesingahambi ngokomthetho (constitutes a non-valid and non-legal application) yaye i-Health Risk Manager ayisayi kusiphicotha eso sicelo sekhefu. Kwiimeko ezilolu hlobo, iSebe linyanzelekile ukuba lifake ikhefu elingahlawulelwayo okwelo thuba lokungabikho lichaphazelekayo.

6. Kucelwa wazise okukule setyhula bonke abaqeshwa abaphantsi kolawulo lwakho kwaye uqinisekise ukuba ikopi yale setyhula inikwa usihlalo webhunga lolawulo lesikolo.

7. Iya kuthakazelelwa intsebenziswano yenu ngokumalunga noku kunye neenzame zenu zokuqhubeka nilawula ngendlela eyiyo ikhefu lokugula.
