1. INGCACISO YOKWANDLALELA
1.1 Ngokwenjenje kwaziswa iinqununu namabhunga olawulo ezikolo ukuba uMthetho wezeNgqesho yooTitshala, 1998 (uMthetho 76 ka-1998) (Employment of Educators' Act,1998 (Act 76 of 1998)),ufakelwe isilungiso ngokufakwa kweSiqendu 6A, njengoko sibhengezwe kuMthetho oFakela iZilungiso kwiMithetho yeMfundo, 2002 (uMthetho 50 ka-2002) (Education Laws Amendment Act, 2002 (Act 50 of 2002)). Olu fakelo-silungiso lubonelela ngokuqeshwa kootitshala abangekaqeshwa kunye nabo basandula kugqiba uqeqesho lwabo kwizithuba zokufundisa kungakhange kufunwe ngcebiso yebhunga lolawulo lesikolo.
1.2 Ootitshala abathatha iPhakheji yokuYeka emSebenzini ngokuZithandela (Voluntary Severance Package (VSP)) ngokweSigqibo 3/1996 seBhunga lezeMfundo lezoBudlelwane eMisebenzini (Education Labour Relations Council) (ELRC)) ngo-1996, 1997 nango-1998 okanye abayekiswa ngenxa yokugula, abayi kuqwalaselwa (will not be considered) ngenjongo yokuqeshwa kwakhona phantsi kweSiqendu 6A soMthetho wezeNgqesho yooTitshala, 1998 (uMthetho 76 ka-1998).
1.3 Ootitshala abazicelela ngokwabo ukuba bayekiswe enkonzweni ngokuthatha umhlala-phantsi phambi kwexesha, okanye abakhutshwa ngenxa yokugula nabathe banamathuba okuqhubela phambili ngokunzulu kwikhondo lomsebenzi kwezemfundo abayi kuqwalaselwa (may not be considered) ngenjongo yokuqeshwa kwakhona. 2. AMANYATHELO (IMIGAQO NGOKUBANZI)
2.1 Kwimeko yootitshala abaqeshwa okokuqala ngqa okanye abaqeshwa kwakhona emva kokuqhawula inkonzo unyaka omnye okanye nangaphezu koko, iSebe leMfundo leNtshona Koloni i-WCED, linako
2.1.1 ukwamkela izicelo ezivela kubenzi-sicelo okokuqala ngqa okanye kubenzi-sicelo ababuyela enkonzweni emva kokuqhawula inkonzo;
2.1.2 ukuqhubeka liqwalasele izicelo ezo lizithelekise nezithuba ezikhoyo ezingenamntu; lize
2.1.3 liqeshe ootitshala esikolweni eso, oko kusenziwa phantsi komhlathi 3 apha ngezantsi.
2.2 Makuqatshelwe ukuba kuya kuqala kukhethwe kootitshala abasandula kugqiba uqeqesho kunabo bakhe baqhawula inkonzo.

3. INKQUBO NGOKUMALUNGA NEZI ZITHUBA ZENGQESHO
3.1 Oku kuqeshwa kungenziwa kuphela emva kokuba iSebe leMfundo leNtshona Koloni liye
3.1.1 labonisana nebhunga lolawulo elichaphazelekayo ngesithuba esithile kunye neemfuno zaso;
3.1.2 laqinisekisa ukuba umenzi-sicelo uyazanelisa iimfuno zesithuba yaye unawo namabanga emfundo amiselweyo.
3.2 Kubalulekile ukuqatshelwa kokuba iSebe leMfundo liza kuphumeza iSiqendu 6A ngolu hlobo lulandelayo:

3.2.1 Ukuba isithuba esivulekileyo nesixhaswa ngemali leli Sebe leMfundo sizaliswa okwethutyana, lize ibhunga lolawulo lesikolo lingaphumeleli ukungenisa igama lomtyunjwa lingekapheli ithuba elimiselweyo leenyanga ezimbini, iNtloko yeSebe leMfundo iya kuqesha loo mntu ukweso sithuba uqeshwe okwethutyana imqeshe ngokusisigxina, ukuba uyazanelisa iimfuno zeso sithuba, ingafunanga ngcebiso yebhunga lolawulo lesikolo.

4. OOTITSHALA ABAFANELEKILEYO UKUBA BAQESHWE KWAKHONA
4.1 Lo gama kuya kuqalwa kukhethwe ootitshala abasanda kugqiba uqeqesho, iinqununu namabhunga olawulo ezikolo maziphawule ukuba ootitshala abakhe baqhawula inkonzo baya kuqwalaselwa ngolandelelwano lokufaneleka kwabo kunye nobungakanani bamava abo ngokususela kwinani leminyaka lilonke besenkonzweni.
4.2 Ngootitshala abahlala kwiPhondo leNtshona Koloni kuphela abafanele ukuba baqeshwe njengoko kukhankanyiwe kwiSiqendu 6A. Ngaphezulu, zonke izithuba zengqesho mazizaliswe ngokuthathela ingqalelo umgaqo-nkqubo wobulungisa kwezengqesho.
4.3 Otitshala abayiqhawulayo inkonzo baya kuqeshwa ngokuthi bahlelwe ngokwezi ndidi zilandelayo ukuqinisekisa ukufaneleka kwabo ukuba baqeshwe:
4.3.1 Ootitshala abangaqeshwanga okanye abaqeshwe okwethutyana kunye/okanye ootitshala abangabanga nathuba lakuqhubela phambili ngokunzulu ngekhondo lomsebenzi wezemfundo nabankonzo yabo ingazange inqunyanyiswe lisebe elalibaqeshile ngenxa yesenzo sokuziphatha kakubi okanye sokunyamalala emsebenzini (abscondence) kwiminyaka emibini edlulileyo.
4.3.2 Ootitshala abangazange barhoxa enkonzweni kwiminyaka emibini edlulileyo phambi kwalo mhla wokuqeshwa kweso sikhundla.
4.3.3 Abanye ootitshala abaqeshwe okwethutyana okanye abangaqeshwanga, oko kuthi, ootitshala ababegxothiwe okanye abanyamalalayo emsebenzini okanye abarhoxayo enkonzweni kwiminyaka emibini edlulileyo.
4.3.4 Ootitshala abangaqeshwanga abenza isicelo sokunikwa iPhakheji yokuYeka emSebenzini ngeMvumelwano naBasebenzi ka-2001 (Mutually Agreed to Severance Package) (MASP)) okanye iPhakheji yokuYeka emSebenzini ka-2003 (Severance Package (SP) of 2003).

5. UKUVUNYWA KWABATYUNJIWEYO

Igunya lokuvuma amagama atyunjiweyo ngokweSiqendu 6A lithweswe abaphathi beesekethe abakhulu (senior circuit managers) abakumaziko ngamaZiko oLawulo noPhuhliso lweMfundo (Education Management and Development Centres) (EMDCs).


6. NGOKUBANZI
6.1 Ziyacelwa iinqununu ukuba zinike ikopi yale setyhula oosihlalo bamabhunga olawulo ezikolo ukuqinisekisa ukuba banolwazi ngolu fakelo-silungiso lwamvanje lwenziweyo.
6.2 Nceda wazise okubhalwe kule setyhula bonke ootitshala abakwiziko lakho, kwi-ofisi yakho okanye kwicandelo lakho, kubandakanywa nabo basekhefini, uze ubacele ukuba bayisayine baze babhale nomhla abayifunde ngawo ukubonisa ukuba balufumene olu xwebhu.
