1. UMphathiswa waBasebenzi beNkonzo zikaRhulumente kuZwelonke uthe wakhupha isigqibo esingokuqaliswa kwePhakheji yokuQhawula iNkonzo okuQalwa ngaBasebenzi (Employee-Initiated Severance Package (EISP)).

2. UKUSEBENZA KWESI SIGQIBO

Esi sigqibo sisebenza kubo bonke ootitshala abaqeshwe ngokusisigxina ngokoMthetho weNgqesho yooTitshala, 1998, (uMthetho 76 ka-1998) (Employment of Educators Act, 1998), njengoko ufakelwe umbandela. Asibandakanyi ootitshala abaqeshwe okwethutyana (appointed temporarily) okanye abaqeshwe ngemvumelwano yexesha eliqingqiweyo (on a fixed-term contract).


3. INJONGO YESIGQIBO
3.1 Injongo yesi sigqibo kukuvumela ootitshala abachatshazelwe yinguqu nohlenga-hlengiso (transformation and restructuring) nabanqwenela ukushiya inkonzo yeSebe leMfundo leNtshona Koloni, ukuba benze izicelo zokunikwa iphakheji yokuqhawula inkonzo okuqalwa ngabasebenzi, ekuya kuthi, ukuba zivunyiwe, kufuneke ukuba utitshala akhutshwe kwinkonzo yeSebe leMfundo leNtshona Koloni.
3.2 ISebe leNkonzo kaRhulumente noLawulo (Department of Public Service and Administration (DPSA)) linike le ngcaciso ilandelayo ukucacisa ukuba kuthetha ukuthini na oku "ootitshala" abachatshazelwe yinguqu nohlenga-hlengiso ("educators" affected by transformation and restructuring):

Eneneni xa kusenziwa oku, iimeko ezinjengezi ziya kuphathelela ngqo koku kulandelayo:

  • Ukubonelelwa kweenkonzo zikarhulumente kuluntu ngokufanayo

  • Ukubakho kwabasebenzi abamele zonke iintlanga

Uhlenga-hlengiso (Restructuring)

4. UKUSEBENZA KWESIGQIBO (APPLICATION OF THE DETERMINATION)

Kuphela ngootitshala abachatshazelwa yinguqu nohlenga-hlengiso abangenza izicelo zokukhutshwa enkonzweni, ngokumalunga noMthetho weNgqesho yooTitshala, 1998, (uMthetho 76 ka-1998), yeSebe leMfundo leNtshona Koloni ngokususela kwiphakheji yokuqhawula inkonzo okuqalwa ngabasebenzi. Ukunikwa iphakheji akuxhomekanga kwimeko yokuba loo titshala akanakuvuma okanye akanakufuna ukuqeshwa kwakhona kwinkonzo karhulumente.


5. IZINTO EZIZA KUJONGWA XA KUQWALASELWA IZICELO
5.1 Xa lowo unegunya lokuphumeza isigqibo (executing authority) (okanye umthunywa wakhe (delegate)) efumana isicelo, kufuneka enze isigqibo sokuba ngaba uyasixhasa na okanye akasixhasi isicelo eso.
5.2 Ekuqwalaseleni isicelo, kuya kuthathelwa ingqalelo ezi zinto zilandelayo, njengezona mfuno zisezantsi:
5.2.1 Inxaxheba yokushiya inkonzo yeSebe iWCED kukatitshala malunga nokwazi ukwenza kwalo inkonzo
5.2.2 Ulwazi lukatitshala nokufaneleka kwakhe ukuqhubeka nokuqeshwa
5.2.3 Uhlobo ekuthi ngalo ukushiya inkonzo kukatitshala kuxhase inguqu nohlenga-hlengiso lwesebe
5.2.4 Izizathu ezithile ezibangela ukuba utitshala enze isicelo
5.2.5 Ukubanako kwesebe ukuxhasa ngemali iindleko eziphathelele kwintlawulo yephakheji yokuqhawula inkonzo (umz. ukubuyisa imali yeNgxowa-mali yoMhlala-phantsi (Pension Fund), intlawulo yokuqhawula inkonzo, intlawulo yekhefu njl. njl.)
5.2.6 Indima edlalwa kukunikwa iphakheji yokuqhawula inkonzo ekuchaphazeleni umoya wokuqhubeka nomsebenzi (morale) kwabanye ootitshala
5.2.7 Ngaba utitshala lowo ukwisithuba esabelwe isebe ngokusemthethweni (department's establishment) okanye ngaba utitshala ngumntu owongezelelweyo kwizithuba zesebe

6. ISAZISO SOKUPHELISA INKONZO

Akufumana incwadi evuma isicelo sakhe, kufuneka utitshala akhutshwe enkonzweni ngokungqinelana noMthetho weNgqesho yooTitshala, 1998, (uMthetho 76 ka-1998). Ukuphuma kukatitshala enkonzweni makwenzeke lingekapheli ithuba eliziinyanga ezimbini emva komhla wesaziso sesigqibo sokuvuma isicelo sakhe.


7. IMIBA NGOKUBANZI (GENERAL ASPECTS)
7.1 Nasiphi na isimangalo sokuziphatha kakubi okanye ukungakwazi kwenza umsebenzi kukatitshala makuqalwe kusingathwe kugqitywe phambi kokuba kube nokuqwalaselwa isicelo sakhe.
7.2 Ukuba saliwe isicelo, akukho mfuneko yakusithumela isicelo eso kuMpathiswa weMfundo kuZwelonke (National Minister of Education).
7.3 Ukuba saliwe isicelo, makuboniswe izizathu ezibhaliweyo zokwaliwa kwaso .
7.4 Ootitshala mabaxelelwe ngelungelo labo lokufikelela esigqibeni sokuba siphinde sihlalelwe kwakhona isicelo eso (review). Ngokumalunga noku makungqinelwane noMthetho wokuKhuthaza uLawulo ngoBulungisa, 2000 (Promotion of Administrative Justice Act (PAJA), 2000.

8. UKUJONGWA BANZI KWEZINTO EZIQWALASELWAYO XA KUSENZIWA ISIGQIBO

Ukujongwa banzi kwezinto eziqwalaselwayo xa kusenziwa isigqibo ngesicelo njengoko zichazwe kumhlathi 5.2 apha ngasentla kwenzelwa ukufumana uthelekiso oluvokothekileyo (sound balance) phakathi kokwenziwa kwenkonzo nezinto ekunyanzelekileyo ukwenziwa ukuze kubekho inguqu (ubulungisa kwezengqesho (employment equity) ngenjongo yokuba nabasebenzi abamele zonke iintlanga ngakumbi). Isigqibo somphathiswa sijolise okokuqala ekubeni inkonzo karhulumente eyenzelwa uluntu ihlale iqhubeka kwaye izinze ingaphazanyiswa nto. Ngako oko ke kucace gca ukuba ayizizo zonke izicelo eziya kuphumelela. Kuya kufuneka kulandelwe inkqubo ethathela ingqalelo zonke iinkalo (holistic approach) ukuqinisekisa ukuba iSebe iWCED aliphulukani nabasebenzi abanezakhono nabaziingcali abaxabiseke kakhulu.


9. OOTITSHALA ASELE BECHATSHAZELWE YINGUQU NOHLENGA-HLENGISO LWANGAPHAMBILI

Bonke ootitshala esele kuthiwe bangaphezu kwemfuneko bangenza izicelo zokuqhawula inkonzo.


10. INKQUBO YOKUQWALASELWA KWEZICELO

Izicelo mazingeniswe ngolu hlobo lulandelayo:

10.1 Ootitshala mabazalise ifom yokwenza isicelo (isiHlomelo A) eqhotyoshelweyo.
10.2 Ifom yokwenza isicelo mayingeniswe kumlawuli wakhe/kwintloko yeziko yakhe ngenjongo yokuba anike iikhomenti/ingcebiso. Inqununu (umphathi wesekethe kwimeko yenqununu) mayongeze iikhomenti zayo/ingcebiso yayo kwiCandelo B lesiHlomelo A.
10.3 Ifom yesicelo ezaliswe zonke iinkcukacha mayingeniswe kwi-Ofisi yezaBasebenzi (Personnel Office), ukuba iqwalaselwe nguNks MHW Engelbrecht, Room 10-03, ekuya kuba nguye osingatha le nkqubo ukuyisa phambili kwaye azidibanise zonke izicelo.

11. INKQUBO YOKWENZA IZIGQIBO

Kucaciswe ezi nkqubo zokwenza izigqibo zilandelayo kwisigqibo soMphathiswa weMfundo kuZwelonke (National Minister of Education):

11.1 ILungu leSigqeba soLawulo (Member of the Executive Council (MEC)) elichaphazelekayo (okanye umthunywa walo) malibonise ukuba ngaba liyasixhasa okanye alisixhasi isicelo.
11.2 UMphathiswa weMfundo kuBasebenzi baseOfisini (okanye umthunywa wakhe) makanike uluvo lwakhe ngokumalunga nesicelo.
11.3 ILungu leSigqeba soLawulo MEC (okanye umthunywa walo) malenze isigqibo sokugqibela.

12. Kucelwa uncede uqinisekise ukuba bonke ootitshala/abasebenzi abaqeshwe phantsi koMthetho weNgqesho yooTitshala, bayaxelelwa ngokubhalwe kule setyhula.

13. Iya kuthakazelelwa kakhulu intsebenziswano yakho ngokumalunga noku.
