1. NgokwemiMiselo 9 no-10 yeSahluko J samaNyathelo oLawulo lwaBasebenzi (Personnel Administration Measures (PAM)), nomMiselo F (c) weCandelo V lemiMiselo yeNkonzo kaRhulumente, 2001, kwakunye nemihlathi 13 no-14 yoMyalelo ongeKhefu lokuNgabikho emSebenzini kwiNkonzo kaRhulumente (Directive on Leave of Absence for the Public Service), iNtloko yeSebe leMfundo inokunika umqeshwa, oontsuku zakhe zekhefu lokugula eliqhelekileyo (eziyi-36 ngomjikelo oyiminyaka emithathu (three-year cycle)) zisetyenziswe zaphela, elinye ikhefu lokugula elongezelelweyo (ikhefu lokungaphili okwethutyana (temporary sick leave)). Ikhefu lokugula elongezelelweyo linikwa ngokujonga imeko yesicelo ngasinye esenziweyo nasemva kokuqwalasela iimeko kunye neencwadi zoogqirha zokugula neengxelo zoogqirha ekufuneka zihambe nesicelo eso njengobungqina.
2. NgokweShedyuli 8 yoMthetho wezoBudlelwane eMsebenzini, 1995 (UMthetho 66 ka-1995) (Labour Relations Act, 1995 (Act 66 of 1995), umqeshi makathi, zingaphelanga iintsuku eziyi-30 emva kokufumana esinye isicelo sokunikwa ikhefu lokugula elingaphezulu somqeshwa okhefu lakhe lokugula (leentsuku eziyi-36) lisetyenziswe laphela, enze isigqibo ngohlobo nobungakanani bokungaphili (incapacity) komqeshwa. Ngokuxhomekeka kuhlobo nobungakanani bokungaphili, umqeshi uya kuthi ke ngoko amazise umqeshwa ngesigqibo sakhe kunye nangenye inkqubo, ukuba kuthe kanti uhlobo lokungaphili kwakhe kokusisigxina kwaye kuchaphazela imeko yakhe ngokupheleleyo (permanent and comprehensive nature).
3. Ukusetyenziswa ngokugqithisileyo kwekhefu lokugula kungoyena nobangela wenkxalabo ophambili kwinkonzo karhulumente, njengoko oko kuthi kuchaphazele ukuzibophelela komqeshi ekwenzeni iinkonzo. Ngako oko ke kugxininiswa ngamandla kusetyenziso nolawulo lwekhefu, ingakumbi ikhefu lokugula yaye le migqaliselo ekhankanywe apha ngasentla ibeka uxanduva emagxeni omqeshi nomqeshwa bobabini ukuba bathobele le miqathango imiselweyo ngokumalunga noku. Abaqeshwa mabaqaphele ukuba kunyanzelekile ukuba bafake isicelo sekhefu lokungaphili zingekapheli iiintsuku ezi-5 emva kokuba beye baqonda ukuba bafuna okanye banokufuna ikhefu elilolu hlobo. Umqeshwa ongekhoyo emsebenzini ngenxa yokugula. Sele esebenzise iintsuku zekhefu lakhe lokugula eziyi-30 kumjikelo othile aze ugqirha acebise ukuba kufuneka ezinye iintstuku ezili-15 zokuba achache. Oku kuya kuthetha ukuba udlule kwiintsuku zakhe zekhefu lokugula ezivumelekileyo eziyi-36 kumjikelo ngeentsuku ezili-9. 4. Kwinzame zokulawula le ngxaki yokusetyenziswa ngokugqithisileyo kwekhefu lokugula, iSebe leNKonzo kaRhulumente noLawulo njengesebe elikhokelayo, ngemvume yeKhabhinethi liye laqulunqa umgaqo-nkqubo ofanayo (uniform policy), noza kusetyenziswa kuwo onke amacandelo enkonzo karhulumente. Lo mgaqo-nkqubo unikwe eli gama UMgaqo-nkqubo neNkqubo yeKhefu lokuNgaphili noMhlala-phantsi ngenxa yokuGula (Policy and Procedure on Incapacity Leave and Ill-health Retirement (PILIR)) kwaye uqale ukusebenza kuRhulumente wePhondo leNtshona Koloni ukususela nge-1 June 2006.
5. Ukuze kuqinisekiswe ukuqwalaselisiswa ngobulungisa (fair evaluation) kwazo zonke izicelo zekhefu lokugula elongezelelweyo, nokuba ngaba lusuku olunye kuphela ngaphezu kweentsuku zekhefu lokugula eziyi-36 kumjikelo nanelungelo lazo, kwakunye nokulungiselela ukusingathwa ngokukhawuleza kwezicelo zokuphuma enkonzweni ngenxa yokugula, kuqeshwe lo mboneleli-nkonzo ozimeleyo, SOMA INITIATIVE njengeHealth Risk Manager wePhondo leNtshona Koloni. Lo mbutho, owenziwa ngoogqirha neengcali zonyango (medical practitioners and specialists), uya kunika iingcebiso kwiSebe leMfundo leNtshona Koloni (WCED) malunga nohlobo nobungakanani bokungaphili kwabasebenzi, ukuba kufuneka kunikwe elinye ikhefu lokungaphili elongezelelweyo nokuba umqeshwa aphume enkonzweni. Iingcebiso zawo ziya kunceda iSebe iWCED, ukuba likwazi ukwenza izigqibo linolwazi malunga nokusingatha izicelo. Mayigxininiswe into yokuba uxanduva luzinze emagxeni abaqeshwa ukuza nobungqina bokuba abanako ukwenza imisebenzi yabo nokuba bonke ubungqina obuyimfuneko obufunwa yiHealth Risk Manager buya kunikwa ngumenzi-sicelo.
6. Njengoko kukhankanyiwe kumhlathi 3 apha ngasentla, kufuneka abaqeshwa bafake isicelo sokucela ukunikwa ikhefu lokugula elongezelelweyo ngendlela emiselweyo ngokusebenzisa iifom ezintsha, zingekapheli iiintsuku ezi-5 emva kokuqala kwekhefu lokungaphili. Kuselilungelo lomqeshwa ukwenza isicelo sekhefu lokugula elongezelelweyo okanye ukwenza isicelo sokuphuma enkonzweni ngenxa yokugula, kodwa kwakuhlala kulilungelo lomqeshi ukuvuma okanye ukwala izicelo ezilolu hlobo okanye ukufikelela esigqibeni kwimeko yekhefu sokuba libe lide kangakanani na ithuba lokumnika inkxaso umqeshwa. Nakuba kunjalo, igalelo leHealth Risk Manager liya kuncedisa ekukhawuleziseni izigqibo nasekuqinisekiseni ukuba kwenziwa izigqibo ezizizo.
7. Ngokwalo mgaqo-nkqubo umtsha umqeshi (iSebe iWCED) unyanzelekile ukuba enze isigqibo esithile kwiintsuku eziyi-30 emva kokufumana isicelo esizaliswe zonke iinkcukacha ngokuchanekileyo. Esi sigqibo siya kuthathwa kwi-Ofisi yezaBasebenzi kwaNdlunkulu, nekuyiyo edluliselwe igunya ngokumalunga noku (delegated authority in this regard). Abaqeshwa ke ngoko baya kwazi ngethuba elifutshane noko malunga nezigqibo ezo. Oku kuya kunceda kwakhona iisuphavayiza ekwenzeni amanye amalungiselelo afanelekileyo nasekulawuleni abasebenzi babo bhetele.

9. Ukucacisa, iifom ezichaphazelekayo neemeko emazisetyenziselwe zona zichazwa ngokufutshane apha ngezantsi:
