UKUSEBENZA KWESI SIGQIBO

2.1 |

Kusalindelwe isigqibo kuMphathiswa wezeMfundo kuZwelonke sokuba ngaba le Phakheji yokuQhawula iNkonzo okuQalwa ngaBasebenzi (EISP) iza kusebenza na kubaqeshwa abangootitshala.

3.1 |
Injongo yesi sigqibo kukuvumela abaqeshwa abachatshazelwe yinguqu nohlenga-hlengiso (transformation and restructuring) nabanqwenela ukushiya inkonzo karhulumente, ukuba benze izicelo zokunikwa iphakheji yokuqhawula inkonzo okuqalwa ngabasebenzi, kuze kuthi ukuba zivunyiwe, kufuneke ukuba umqeshwa azirhoxele ngokwakhe (resign voluntarily) kwinkonzo karhulumente.

UKUSEBENZA KWESIGQIBO (APPLICATION OF THE DETERMINATION)
Kuphela ngabaqeshwa abachatshazelwa yinguqu nohlenga-hlengiso abangenza izicelo zokuzirhoxela ngokwabo enkonzweni karhulumente ngokususela kwiphakheji yokuqhawula inkonzo okuqalwa ngabasebenzi, njengoko kuchaziwe kwisiHlomelo EISP esiqhotyoshelweyo.

IZINTO EZIZA KUJONGWA XA KUQWALASELWA IZICELO

5.1 |
Xa lowo unegunya lokwenza oku (okanye umthunywa wakhe (delegate)) efumana isicelo, kufuneka enze isigqibo sokuba ngaba uyasixhasa na okanye akasixhasi isicelo eso.

ISAZISO SOKUPHELISA INKONZO
Akufumana incwadi evuma isicelo sakhe, kufuneka umqeshwa abhale incwadi yokwazisa ngokurhoxa kwakhe kwinkonzo ngokungqinelana nemiMiselo yeNkonzo kaRhulumente 2001 (ISahluko 1, ICandelo VII G 2.3) (Public Service Regulations, 2001 (Chapter 1, Part VII G 2.3). Ukuphuma komqeshwa enkonzweni makwenzeke lingekapheli ithuba eliziinyanga ezimbini ususukela kumhla wesaziso sesigqibo sokuvuma isicelo sakhe.

UKUJONGWA BANZI KWEZINTO EZIQWALASELWAYO XA KUSENZIWA ISIGQIBO
Ukujongwa banzi kwezinto eziqwalaselwayo xa kusenziwa isigqibo ngesicelo ezichazwe kumhlathi 5.2 apha ngasentla kwenzelwa ukufumana uthelekiso oluvokothekileyo (sound balance) phakathi kokwenziwa kwenkonzo nezinto ekunyanzelekileyo ukwenziwa ukuze kubekho inguqu (ubulungisa kwezengqesho (employment equity) ngenjongo yokuba nabasebenzi abamele zonke iintlanga ngakumbi).

ABAQESHWA ASELE BECHATSHAZELWE YINGUQU NOHLENGA-HLENGISO LWANGAPHAMBILI
Bonke abaqeshwa esele kuthiwe bangaphezu kwemfuneko bangenza izicelo zokuqhawula inkonzo. Abaqeshwa abasebatsha abanqwenela ukuhlala enkonzweni bangatshintshiselana ngemeko yabo yokuba ngaphezu kwemfuneko (exchange their excess status) nabasebenzi abadala abanqwenela ukushiya inkonzo. Nakuba kunjalo, olo tshintshiselwano luya kuvunywa kuphela xa abaqeshwa abo belingana ngokwesikhundla kwaye/okanye bekwindawo yomsebenzi enye. Ukuba abaqeshwa abanqwenela ukutshintshiselana ngeemeko zabo abekho kwindawo enye, ezo ndawo bakuzo mazibe kumgama okufuphi enye kwenye ukwenzela ukuba kube lula ukuthathwa komqeshwa ongaphezu kwemfuneko kweso sithuba sivelileyo.

Kucelwa uncede uqinisekise ukuba bonke abasebenzi abaqeshwe phantsi koMthetho weNkonzo kaRhulumente (all Public Service Act staff members) bayaxelelwa ngokubhalwe kule setyhula. Iya kuthakazelelwa kakhulu intsebenziswano yakho ngokumalunga noku.
