1. INGCACISO YOKWANDLALELA
1.1 Le setyhula yongeza okukwiSetyhula 0238/2003 yomhla wesi-4 Disemba 2003.
1.2 ICandelo VIII leMimiselo yaBasebenzi beNkonzo kaRhulumente (Public Service Regulations (PSR), licacisa ukuba makumiselwe inkqubo yolawulo nophuhliso lwentsebenzo yabasebenzi abakwizikhundla ezikumanqanaba 1 - 12.
1.3 Inkqubo yolawulo nophuhliso lwentsebenzo yabasebenzi (SPMDS) ijolise kwiziphumo, yaye ithetha inkqubo ethe gqolo yokuqinisekisa ukuba abasebenzi bayayazi ncam into elindelekileyo kubo, baxhotyiswa ngokufanelekileyo ukuba benze oko kulindelwe kubo, yaye bavelise iziphumo ezifunwayo kubo. Le nkqubo ikwabandakanya uvavanyo lwentsebenzo (i-apreyizali).
1.4 Umjikelo wentsebenzo uthatha unyaka omnye, o.k.t. ukususela kowoku-1 Apreli wonyaka othile ukuya kowama-31 Matshi wonyaka olandelayo. Ezi zigaba zithungeleneyo zihamba nalo mjikelo zinokushwankathelwa ngolu hlobo lulandelayo:
  • Ukuveliswa kweSicwangciso seNtsebenzo soMntu ngamnye neSicwangciso soPhuhliso soMntu ngamnye esisiphumo seengxoxo zokubonisana kufuneka zibonakalise imvumelwano ngeziphumo/ngeziqhamo ekufuneka kufikelelwe kuzo kumjikelo wolawulo lwentsebenzo othile

  • Ukusoloko kubekwe esweni okokoko intsebenzo yomqeshwa nokunika ingxelo ngayo, esekelwe kubungqina obuqokelelweyo, ngokuthi ihlolwe ngekota kuzo zo-4 iikota zomjikelo

  • Ukuphuhliswa kwamandla omqeshwa okusebenza ngomjikelo wentsebenzo uphela

  • Ukwenziwa kovavanyo lwentsebenzo (i-apreyizali) qho ngonyaka oluba sekupheleni komjikelo wentsebenzo (ngoMatshi) apho intsebenzo yomsebenzi kuloo mjikelo ivavanywayo okanye ibekwa esikalini.

2. IPROJEKTHI ENGUVULINDLELA (PILOT PROJECT)
2.1 NgokweSiqendu C3, iCandelo VIII le-PSR, ka-2001, kufuneka isebe livavanye le nkqubo kumaqela abasebenzi kuwo onke amaqela abaqeshwa phambi kokuba libe nokusebenzisa le nkqubo.
2.2 ISebe leMfundo leNtshona Koloni laqhuba iprojekthi enguvulindlela kwisampula yabasebenzi balo kuwo onke amanqanaba nakuzo zonke izikhundla zomsebenzi (kwaNdlunkulu, kwii-EMDC nasezikolweni) kwithuba elisusela kumhla woku-1 Apreli 2003 ukuya kowama-31 Matshi 2004. Iingxelo ezifumaneke kule nkqubo ziye zabandakanywa ngokwe-SPMDS. (Qwalasela incwadana yomgaqonkqubo egqagamshelweyo)

3. UMHLA WOKUQALISWA NAMALUNGISELELO ETHUBA LENGUQU (TRANSITIONAL ARRANGEMENTS)
3.1 INkqubo entsha yeSicwangciso soLawulo noPhuhliso lweNtsebenzo yaBasebenzi (SPMDS) ithatha indawo yezi nkqubo ezikhoyo zokuvavanywa kwentsebenzo yaye iqalise ukusebenza ngomhla woku-1 Apreli 2004.
3.2 Kulo mjikelo wokuqala wolawulo lwentsebenzo ophela ngomhla wama-31 Matshi 2005, kuza kusetyenziswa ixesha elifinyeziweyo lovavanyo eliziinyanga ezisi-8 ukulungiselela ithuba lenguqu.
3.3 Le nkqubo njengangoku iyaqaliswa, yaye uqeqesho olujolise ekuvelisweni kweZicwangciso zeNtsebenzo noPhuhliso loMntu ngamnye luza kuqhutywa kwithuba elisusela kowe-14 Juni 2004 ukuya kowesi-10 Agasti 2004.
3.4 Zonke iisuphavayiza/abaphathi bamacandelo kulindeleke ukuba baqinisekise ukuba iZicwangciso zeNtsebenzo noPhuhliso loMntu ngamnye zalo mjikelo okhoyo ziye zagqitywa ngokumalunga nabo bonke aBasebenzi beNkonzo kaRhulumente, ungadlulanga owama-31 Agasti 2004.
3.5 Iiseshoni zokuhlolwa kwentsebenzo ngekota yokuqala neyesibini mazibe zigqitywe ngowe-10 Novemba 2004 nangowama-21 Februwari 2005, ngokulandelelanayo. Malube selugqityiwe uvavanyo lwentsebenzo (i-apreyizali) ngowe-10 Matshi 2005.
3.6 Eli sebe liza kunika inkxaso ngalo lonke ixesha lokuqhubeka kwezi nkqubo lize lingenelele ngoncedo apho kuyimfuneko. Iiseshoni ezilandelayo, eziya kujolisa ngakumbi kwiinkqubo zokuhlolwa kwentsebenzo nezovavanyo lwentsebenzo, ziza kwenziwa nazo kwakuba nje kugqitywe iZicwangciso zeNtsebenzo noPhuhliso loMntu ngamnye.
3.7 Ithuba lovavanyo olupheleleyo lweenyanga eziyi-12 liya kusebenza kumjikelo wentsebenzo olandelayo, ongulo, 1 Apreli 2005 ukuya kuma-31 Matshi 2006, nekufuneka ngethuba lokuqhubeka kwawo kuhlolwe intsebenzo ubuncinane kayi-4 ngekota, kuze ke kulandele iseshoni yovavanyo lwentsebenzo ngoMatshi 2006.

4. UKUVUZWA NGENTSEBENZO

Umqeshwa ngokwenkqubo epheleleyo yoLawulo lweNtsebenzo noPhuhliso lwaBasebenzi (SPMDS) osebenza ngenqanaba elamkelekileyo/elincomekayo/eligqwesayo, uye akufanele ukunyuselwa umvuzo, ukufumana imali eyibhonasi okanye ukuvuzwa ngento engeyomali.

4.1 Unyuselo-mvuzo
4.1.1 Unyuselo-mvuzo okokuqala lwasetyenziswa ngowoku -1 Julayi 2003, ngokususela kwintsebenzo yethuba langowoku-1 Apreli 2002 ukuya kowama-31 Matshi 2003. Ngekwesibonelelo sethutyana, isatifikethi kufuneka sigcwaliswe ngumphathi wecandelo ngalinye/isuphavayiza ukuqinisekisa ukuba umsebenzi wabasebenzi babo uyonelisa.
4.1.2 Ukufanelekela ukuba afumane unyuselo-mvuzo, ngokumayela ne 1/7/2004, esinye isatifikethi, njengesibonelelo sethutyana, kufuneka sizaliswe sethuba elisusela kowoku-1 Apreli 2003 ukuya kowama-31 Matshi 2004 size singeniswe kwiGosa eli Lawula iNtsebenzo, kwiCandelo loLawulo lwaBasebenzi kwiSebe labaSebenzi bakaRhulumente, kule dilesi ingasentla ungadlulanga u-Agasti 2004.
4.1.3 Unyuselo-mvuzo okokuqala lwabasebenzi beSebe leMfundo leNtshona Koloni (WCED), emva kokusetyenziswa ngokusesikweni kwe-SPMDS luya kwenzeka ngowoku-1 Julayi 2005 yaye luya kusekelwa koku kulandelayo:
  • Inkonzo yonyaka omnye opheleleyo kwinotshi yomvuzo kunye novavanyo lwentsebenzo olumbeka ubuncinane kwintsebenzo “eyamkelekileyo” ngokwe-SPMDS ngelo thuba libekiweyo.

  • Le nkqubo iya kubandakanya umqeshwa otshintshe kwicandelo lomsebenzi othile ukuya kwelinye okanye osuka kwelinye isebe ukuya kwelinye apho umqeshwa ahlale kuloo notshi inye.

  • Umqeshwa okwinotshi yakhe buqu yomvuzo (personal notch) engaphezu kwelona nqanaba liphezulu lomvuzo wesithuba sakhe akayi kufaneleka ukuba afumane unyuselo-mvuzo, kodwa uya kufumana uhlenga-hlengiso lomvuzo wonyaka njengoko lunokumiselwa nguMphathiswa waBasebenzi beNkonzo kaRhulumente noLawulo.

4.2 Imali eyibhonasi

Kunokucingwa nangemali eyibhonasi eyona inkulu ibe yi-10% kunye ne-18% yomvuzo womqeshwa ukuthathela ingqalelo uhlelo lwentsebenzo iyonke (ireyithingi) oluku-4 no-5 ngokulandelelanayo. Unikezelo lwentlawulo yebhonasi luya kuqwalaselwa emveni kokuba kugqitywe umjikelo okhoyo ophela nge-31 Matshi 2005. Nangona kunjalo, intlawulo yebhonasi ixhomekeke ekubenikho kwemali.

4.3 Ukuvuzwa ngezinto ezingeyomali

ISebe leMfundo leNtshona Koloni liya kuthi, amaxesha ngamaxesha, lazise iindlela zokuqaphela intsebenzo ngezinto ezingeyomali ukukhuthaza intsebenzo kwiSebe liphela. Nakuba kunjalo, iintloko zamacandelo/abaphathi bamacandelo bakhululekile ukuba nabo bavelise ezabo indlela zokuqaphela intsebenzo, ngoku- xhomekeka ekubeni zihlale zingeyomali kwaye zingatshintshi nayiphi na imeko yengqesho esisiseko.
