The measures regarding the granting of special leave for extraordinary circumstances are as follows:

1. Subject to the provisions of section 18(1)(j) of the Employment of Educators Act, 1998 (Act 76 of 1998) and notwithstanding any disciplinary measures that may apply, unauthorised absence by an educator is regarded as special leave in extraordinary circumstances and shall be without pay unless the Western Cape Education Department (WCED), in a specific case, determines otherwise.

2. If, in the opinion of the WCED, circumstances justify it, it may grant, or place an educator on, special leave in extraordinary circumstances for any reasonable purpose and for any reasonable period, and such leave shall be without pay unless the WCED determines otherwise.

3. Special leave in extraordinary circumstances is not deducted from the leave credits of the educator.

4. Educators who apply for special leave in extraordinary circumstances must submit the completed leave form and written motivation/reasons for the leave before the commencement of the leave. The utilisation of the leave remains subject to the prior approval of the WCED.

5. Please bring the contents of this circular to the attention of all educators in your institution/ office/ directorate, including those on leave, and have them sign and date it. Principals must ensure that a copy of this circular is given to the chairperson of the School Governing Body for information.

6. You are kindly requested to place a copy of this circular together with copies of the other circulars on leave in a separate file/cover for future use/reference purposes.
