1. Your attention is drawn to an article in the media in which pensioners were informed that a surplus had occurred in the pension fund as a result of the Pension Fund Amendment Act, Act 39/2001 and that the surplus would be redistributed to members and ex-members of the fund.

2. After receiving several enquiries from educators, the Western Cape Education Department wishes to confirm that the above-mentioned Act does not apply to funds that are not registered in terms of the Pension Fund Act. Public Service employees are members of the Government Employees Pension Fund, which is governed by the Government Employees Pension Law of 1996, and they are therefore excluded from the benefits referred to in the article.

3. You are urgently requested to bring the contents of this circular to the attention of all personnel.
