1. The period for the implementation of the Framework Agreement: Transformation and Restructuring of the Public Service (PSCBC Resolutions 7 and 8 of 2002) terminates on 13 June 2003, but may possibly be extended by 3 months.
2. All education institutions are in possession of their approved staff establishments for 2003 on the basis of which they are now required to determine which post(s) and educator(s) is/are in excess.
3. Where an educational institution exceeds its approved staff establishment, i.e. where there are more permanent educators at the institution than indicated in the approved staff establishment, such an institution must embark on a process to declare which post(s) and educator(s) are in excess as per the attached procedure.
4. The procedure for declaring educators in excess was agreed to at the Departmental Task Team meeting held on 25 February 2003.
5. The procedure will enable the Western Cape Education Department to fulfil its obligations towards these excess educators as provided for in the framework agreement, viz.

  • alternative employment mechanisms (e.g. matching and placement) for employees in excess
  • the redeployment and retraining of personnel
  • the advertising of posts in closed vacancy lists
  • the development of sector job creation strategies within sectoral councils
  • a severance package on application
  • a severance package for employees/personnel who cannot be redeployed.

    7. For the sake of completeness, this circular must be read in conjunction with Circulars 0116/2002 and 0008/2003 of 19 September 2002 and 8 January 2003 respectively.
    8. All parties are requested to assist with and support the implementation of this framework agreement as its success depends on the co-operation of employers, governing bodies and councils of educational institutions.

    Heads of educational institutions are requested to bring the contents of this circular to the attention of all their staff members and request them to date and sign an acknowledgement of receipt.
