Educational institutions were provided with their approved staff establishments for 2004 under cover of Circular 0182/2003. This new circular provides added information with regard to paragraph 4 of the aforementioned circular and replaces of 10 March 2003. |

If an educational institution exceeds its approved staff establishment, i.e. where there are more permanent educators at the institution than indicated in the approved staff establishment, such an institution must set a process in motion to declare which post(s) and educator(s) are in excess. The rightsizing must be done in terms of Collective Agreement 2/2003 (copy attached), the content of which is self-explanatory. |

As indicated in Collective Agreement 2/2003, the circuit manager must invite one representative per trade union party to the Provincial Education Labour Relations Council (PELRC) to observe the process. Proof of the invitations (e.g. facsimile transmission slips) must be kept on record. All correspondence must be sent to the provincial office of the unions concerned and all the information used at this meeting must be made available to all parties present at the meeting. Notification of at least five working days must be given for all meetings. |

An educator who has been identified as being in excess must be notified of this in writing by the circuit manager (Annexure A - attached), after which the principal must inform the rest of the staff of the outcome. The educator declared in excess must complete and submit the educator profile form (Annexure B - attached) via his or her principal to the circuit manager of the school who must then submit the above-mentioned information to the Directorate: Personnel Management (CS Educators), for attention mr D Flandorp. |

The success of the implementation of Collective Agreement 2/2003 will depend on the co-operation of employees and governing bodies or councils of educational institutions. It should be borne in mind that the process of the rightsizing of excess staff is an ongoing process and that the WCED is committed to the retention of the valuable skills of educators. |

Heads of educational institutions must ensure that all members of staff and governing bodies or councils sign and date an acknowledgement that they are familiar with the contents of this circular. |
